BID PROTEST - ANTI-PINKERTON ACT CONCERNING THE PROTEST OF PLANT SECURITY, INC., AGAINST THE AWARD OF A CONTRACT TO THE INTERNATIONAL SECURITY CORPORATION (INTERSEC) UNDER AN IFB ISSUED BY THE NATIONAL CAPITAL HOUSING AUTHORITY FOR SECURITY GUARD SERVICES. ALTHOUGH THIS PROTEST WAS DENIED BECAUSE THE MERE EXISTENCE OF TELEPHONE DIRECTORY LISTINGS DOES NOT PROVIDE SUFFICIENT EVIDENCE TO QUESTION INTERSEC'S ANTI-PINKERTON ACT CERTIFICATION, THE CONTINUED USE BY INTERSEC OF THESE LISTINGS, WHICH SEEMINGLY HOLD IT OUT AS A DETECTIVE AGENCY WOULD REQUIRE FURTHER INQUIRY AS TO INTERSEC'S ANTI PINKERTON STATUS BEFORE AWARD CAN BE MADE UNDER FUTURE PROCUREMENT.

REFERENCE IS MADE TO THE REPORT FROM THE GENERAL COUNSEL, DATED AUGUST 28, 1972, CONCERNING THE PROTEST OF AMRAM, HAHN & SANDGROUND, ATTORNEYS FOR PLANT SECURITY, INC., AGAINST THE AWARD OF A SECURITY GUARD CONTRACT TO INTERNATIONAL SECURITY CORPORATION UNDER INVITATION FOR BIDS NO. 43.

ENCLOSED IS A COPY OF OUR DECISION OF TODAY DENYING THE PROTEST. INDICATED IN THE DECISION, TELEPHONE DIRECTORY LISTINGS ALONE DO NOT PROVIDE A SUFFICIENT EVIDENTIARY BASIS TO QUESTION, AFTER AWARD, INTERSEC'S BID CERTIFICATION THAT IT WAS NOT WITHIN THE PURVIEW OF THE ANTI-PINKERTON ACT.
