WHILE THE ONLY REASON FOR THIS REQUIREMENT WHICH IS EVIDENT FROM THE RECORD BEFORE US IS THAT THIS CONTRACT HISTORICALLY HAS BEEN AWARDED ON A SOLE SOURCE BASIS TO THAI AIRWAYS AIRCRAFT MAINTENANCE CO. IT IS NOT EVIDENT THAT OTHER FIRMS WOULD NECESSARILY BE DENIED ACCESS AT U-TAPAO. SECRETARY: REFERENCE IS MADE TO THE LETTER DATED JULY 20. ENCLOSED IS A COPY OF OUR DECISION OF TODAY DENYING THE PROTEST. WE HAVE NOTED THE REQUIREMENT IN THIS SOLICITATION THAT THE CONTRACTOR OBTAIN ACCESS TO BOTH THE DON MUANG AIRPORT AND U-TAPAO ROYAL THAI NAVY AIRFIELD TO BE ELIGIBLE FOR ANY AWARD. PROCUREMENT PRACTICES - RECOMMENDATIONS LETTER REGARDING THE PROTEST OF NHA FIELD SERVICES AGAINST THE AWARD OF A CONTRACT UNDER AN RFP ISSUED BY THE THAILAND PROCUREMENT CENTER, U.S. AIR FORCE MILITARY PURCHASING AGENCY, BANGKOK, THAILAND. GAO HAS NOTED THE REQUIREMENT IN THIS SOLICITATION THAT THE CONTRACTOR OBTAIN ACCESS TO BOTH THE DON MUANG AIRPORT AND U-TAPAO ROYAL THAI NAVY AIRFIELD TO BE ELIGIBLE FOR ANY AWARD. WHILE THE ONLY REASON FOR THIS REQUIREMENT WHICH IS EVIDENT FROM THE RECORD BEFORE US IS THAT THIS CONTRACT HISTORICALLY HAS BEEN AWARDED ON A SOLE SOURCE BASIS TO THAI AIRWAYS AIRCRAFT MAINTENANCE CO., LTD., BECAUSE OF THE INABILITY OF OTHERS TO OBTAIN ACCESS TO PERFORM THE SERVICES AT DON MUANG, IT IS NOT EVIDENT THAT OTHER FIRMS WOULD NECESSARILY BE DENIED ACCESS AT U-TAPAO. THE COMP. GEN. THEREFORE SUGGESTS THAT IN FUTURE PROCUREMENTS CONSIDERATION BE GIVEN TO THE FEASIBILITY OF SOLICITING OFFERS FOR PARTIAL AWARDS SO AS TO PERMIT COMPETITION IF ACCESS TO ANY ONE OF THE BASES CAN BE OBTAINED.

REFERENCE IS MADE TO THE LETTER DATED JULY 20, 1972, REFERENCE LGPM, AND ENCLOSURES, FROM THE DEPUTY CHIEF, CONTRACT MANAGEMENT DIVISION, DIRECTORATE OF PROCUREMENT POLICY, DCS/S&L, REPORTING ON THE PROTEST BY NHA, INC., UNDER RFP F62272-72-R-0069, ISSUED BY THE THAILAND PROCUREMENT CENTER, UNITED STATES AIR FORCE MILITARY PURCHASING AGENCY, BANGKOK, THAILAND.

ENCLOSED IS A COPY OF OUR DECISION OF TODAY DENYING THE PROTEST.

MOREOVER, THE RECORD INDICATES THAT THE REQUIREMENTS GENERATED AT U-TAPAO ARE SIGNIFICANTLY GREATER THAN THOSE AT DON MUANG. WE THEREFORE SUGGEST THAT IN FUTURE PROCUREMENTS CONSIDERATION BE GIVEN TO THE FEASIBILITY OF SOLICITING OFFERS FOR PARTIAL AWARDS SO AS TO PERMIT COMPETITION IF ACCESS TO ANY ONE OF THE BASES CAN BE OBTAINED.

THE ENCLOSURES TO THE LETTER OF JULY 20, ONE OF WHICH IS CLASSIFIED SECRET, WILL BE RETURNED UNDER SEPARATE COVER AT A LATER DATE.
