INC.: FURTHER REFERENCE IS MADE TO YOUR LETTER DATED JANUARY 13. THE QUOTATION WAS AMENDED TO INCLUDE ADDITIONAL DETAIL AND EXTENDED THE ACCEPTANCE DATE UNTIL JANUARY 4. THE CONTRACTING OFFICER ADVISED THAT THE RFQ HAD BEEN CANCELED BECAUSE IT WAS IMPOSSIBLE TO EVALUATE THE QUOTATIONS RECEIVED AND THAT A NEW REQUEST FOR QUOTATION WOULD BE ISSUED IN THE NEAR FUTURE. YOU PROTEST THIS CANCELLATION ON THE BASIS THAT IT IS PREJUDICIAL TO YOU AND OTHERS. YOU STATE THAT YOU ARE THE LOW OFFEROR ON A TRUCK COMPARABLE TO THAT REQUIRED UNDER MIL-T-17760. WHICH SHOULD HAVE BEEN SPECIFIED IN THE QUOTATION AND WHICH YOU NOW UNDERSTAND IS TO BE USED UNDER THE NEW ADVERTISEMENT. WE HAVE BEEN ADVISED BY LETTER DATED MARCH 15.

BID PROTEST - CANCELLED RFQ - PROCUREMENT NO LONGER REQUIRED DECISION DENYING THE PROTEST OF SCHRECK INDUSTRIES, INC., AGAINST THE CANCELLATION OF AN RFQ ISSUED BY THE MARINE CORPS BASE, QUANTICO, VA., FOR A PALLET TRUCK. THE PROTEST MUST BE DENIED, SINCE THE GOVERNMENT MAY NOT BE COMPELLED TO PROCURE AN ITEM WHICH IT NO LONGER REQUIRES.

TO SCHRECK INDUSTRIES, INC.:

FURTHER REFERENCE IS MADE TO YOUR LETTER DATED JANUARY 13, 1972, WITH ENCLOSURES, PROTESTING THE CANCELLATION OF REQUEST FOR QUOTATION (RFQ) NO. M00264-72-Q-C374, ISSUED DECEMBER 16, 1971, BY THE MARINE CORPS BASE, QUANTICO, VIRGINIA.

THE RFQ INVITED QUOTATIONS ON A LOW LIFT, BATTERY OPERATED PALLET TRUCK, MODEL PE-40, MANUFACTURED BY THE PRIME-MOVER CO., OR EQUAL. BASED ON YOUR REQUEST FOR NEEDED INFORMATION, THE QUOTATION WAS AMENDED TO INCLUDE ADDITIONAL DETAIL AND EXTENDED THE ACCEPTANCE DATE UNTIL JANUARY 4, 1972. ON JANUARY 11, 1972, THE CONTRACTING OFFICER ADVISED THAT THE RFQ HAD BEEN CANCELED BECAUSE IT WAS IMPOSSIBLE TO EVALUATE THE QUOTATIONS RECEIVED AND THAT A NEW REQUEST FOR QUOTATION WOULD BE ISSUED IN THE NEAR FUTURE. WE HAVE BEEN ADVISED BY LETTER DATED MARCH 15, 1972, FROM THE DEPUTY QUARTERMASTER GENERAL OF THE MARINE CORPS THAT THE REQUIREMENT FOR THE PALLET TRUCK NO LONGER EXISTS AND IT DOES NOT CONTEMPLATE REPROCUREMENT. AS A RESULT OF THIS ACTION, THE MATTER RAISED BY YOUR PROTEST BECOMES AWARD FOR AN ITEM OR QUANTITIES OF AN ITEM WHICH IT NO LONGER NEEDS OR WANTS.

ACCORDINGLY, YOUR PROTEST IS DENIED.
