CIVILIAN EMPLOYEE - REIMBURSEMENT - MISCELLANEOUS EXPENSES DECISION ALLOWING CERTIFICATION OF A PAY VOUCHER IN FAVOR OF MR. ROBERT E. REID, JR., FOR ADDITIONAL MISCELLANEOUS EXPENSES INCIDENT TO A CHANGE OF OFFICIAL DUTY STATION AS AN EMPLOYEE OF THE ATOMIC ENERGY COMMISSION. SINCE THE EXPENSES BEING SOUGHT ARE ALLOWED BY SECTION 3.1 OF OMB CIRCULAR NO. A-56 AND ARE WITHIN THE MAXIMUM EXPENSES ALLOWABLE BASED ON CLAIMANT'S BIWEEKLY SALARY, THE VOUCHER MAY BE CERTIFIED FOR PAYMENT.

TO MR. ROBERT L. LEITH:

REFERENCE IS MADE TO YOUR LETTER DATED DECEMBER 2, 1971, WITH ENCLOSURES, MAKING INQUIRY AS TO WHETHER THE ENCLOSED VOUCHER IN FAVOR OF MR. ROBERT E. REID, JR., AN EMPLOYEE OF THE ATOMIC ENERGY COMMISSION, CLAIMING AN ADDITIONAL AMOUNT FOR MISCELLANEOUS EXPENSES, MAY BE CERTIFIED FOR PAYMENT UNDER THE CIRCUMSTANCES HEREINAFTER DESCRIBED.

THE RECORD SHOWS THAT BY TRAVEL AUTHORIZATION NO. WA-6339, DATED APRIL 26, 1971, MR. REID WAS AUTHORIZED A CHANGE OF OFFICIAL DUTY STATION FROM LAS VEGAS, NEVADA, TO GERMANTOWN, MARYLAND. THE SUBJECT AUTHORIZATION MADE PROVISION FOR THE REIMBURSEMENT OF TEMPORARY QUARTERS, REAL ESTATE EXPENSES, MISCELLANEOUS EXPENSES, AND TRAVEL EXPENSES INCIDENT TO THE USAGE OF A PRIVATELY OWNED AUTOMOBILE BETWEEN THE OLD AND NEW DUTY STATIONS. DUE TO THE SIZE OF MR. REID'S FAMILY HE WAS AUTHORIZED THE USE OF A SECOND AUTOMOBILE PURSUANT TO THE RELOCATION.

THE RECORD FURTHER SHOWS THAT MR. REID WAS REIMBURSED $200 IN MISCELLANEOUS EXPENSES. HE HAS NOW SUBMITTED A SUPPLEMENTAL VOUCHER CLAIMING $346.32 AS AN ADDITIONAL AMOUNT OVER MISCELLANEOUS EXPENSES PREVIOUSLY REIMBURSED. MR. REID HAS NOW SUBMITTED EVIDENCE OF EXPENDITURES IN THE TOTAL AMOUNT OF $546.32 REPRESENTING COSTS INCURRED FOR REGISTERING AND INSPECTING FOUR AUTOMOBILES AND A TRAILER AT HIS NEW DUTY STATION, AND FOR DRIVERS' LICENSES FOR HIMSELF AND FAMILY.

WITH REGARD TO THE INSTANT CLAIM, YOU HAVE STATED THAT THE ADDITIONAL CLAIM IS ADEQUATELY DOCUMENTED, AND -

"REGULATIONS GOVERNING THE ALLOWANCE FOR MISCELLANEOUS EXPENSES CONTAINED IN SECTION 3.1 OF OFFICE OF MANAGEMENT AND BUDGET CIRCULAR NO. A-56, REVISED, INDICATES THE TYPES OF EXPENSES CLAIMED BY MR. REID ARE THOSE TYPES OF COSTS INTENDED TO BE REIMBURSED UNDER THE ALLOWANCE. HOWEVER, AS MR. REID WAS AUTHORIZED THE USE OF BUT TWO AUTOMOBILES IN CONNECTION WITH HIS CHANGE OF OFFICIAL STATION, WE WONDER IF THE MAXIMUM MISCELLANEOUS EXPENSE ALLOWANCE MUST BE RESTRICTED TO TWO VEHICLES (OLDSMOBILE AND FORD PICKUP) AND TWO DRIVER LICENSES PROVIDED SUCH CLAIM DID NOT EXCEED THE MAXIMUM MONETARY ALLOWANCE AS PRESCRIBED BY SECTION 3.3, B. OF CIRCULAR A- 56.

"IF THE EXPENSES PERTAINING TO THE OTHER VEHICLES AND DRIVER LICENSES CAN ALSO BE CONSIDERED ALLOWABLE MISCELLANEOUS EXPENSES, IT APPEARS THAT MR. REID'S CLAIM MAY BE PAID AS SUBMITTED BECAUSE IT DOES NOT EXCEED THE MAXIMUM MISCELLANEOUS EXPENSE ALLOWANCE PRESCRIBED BY SECTION 3.3, B. OF CIRCULAR A-56. *** "

WE AGREE THAT THE EXPENSES NOW BEING SOUGHT ARE PROPER FOR REIMBURSEMENT UNDER SECTION 3.1 OF OFFICE OF MANAGEMENT AND BUDGET CIRCULAR NO. A-56, REVISED JUNE 26, 1969, AND ARE WITHIN THE MAXIMUM MISCELLANEOUS EXPENSES ALLOWABLE BASED ON THE CLAIMANT'S BIWEEKLY SALARY.

THE PROVISION IN THE TRAVEL AUTHORIZATION WITH RESPECT TO USE OF A SECOND AUTOMOBILE PERTAINED ONLY TO A RESTRICTION ON THE REIMBURSEMENT OF MILEAGE EXPENSES ARISING OUT OF TRAVEL IN MR. REID'S PRIVATELY OWNED AUTOMOBILES INCURRED BETWEEN THE OLD AND NEW DUTY STATIONS. IT IS NOT VIEWED NOR MAY IT BE CONSIDERED AS LIMITING THE EXPENSES FOR WHICH MR. REID WOULD BE ELIGIBLE FOR REIMBURSEMENT UNDER SECTION 3.1 OF CIRCULAR NO. A-56.

THE VOUCHER, WITH ACCOMPANYING PAPERS, IS RETURNED HEREWITH AND MAY BE CERTIFIED FOR PAYMENT IF OTHERWISE CORRECT.
