BID PROTEST - INDIVIDUAL SURETIES - REQUIRED SIGNATURES FORWARDING COPY OF DECISION DENYING PROTEST OF CENTRAL BUILDING MAINTENANCE, INC., AGAINST THE AWARD OF A CONTRACT TO NATIONWIDE BUILDING MAINTENANCE, BY HEADQUARTERS, MILITARY DISTRICT OF WASHINGTON. IT IS RECOMMENDED THAT CORRECTIVE ACTION BE TAKEN TO OBTAIN CERTAIN NECESSARY SIGNATURES FROM THE INDIVIDUAL SURETIES AND THEIR WIVES.

TO MR. SECRETARY:

REFERENCE IS MADE TO THE LETTER DATED JUNE 29, 1971, WITH ENCLOSURE, AND TO DOCUMENTS SUBMITTED HERE INFORMALLY ON JULY 16, 1971, CONCERNING THE PROTEST OF CENTRAL BUILDING MAINTENANCE, INC., AGAINST THE AWARD OF A CONTRACT TO NATIONWIDE BUILDING MAINTENANCE, INC., ISSUED BY HEADQUARTERS, MILITARY DISTRICT OF WASHINGTON, D.C.

ENCLOSED IS A COPY OF OUR DECISION OF THIS DATE DENYING THE PROTEST. HOWEVER, WE NOTE THAT THE AFFIDAVIT OF INDIVIDUAL SURETY EDMUND D. MINNEY IN SUPPORT OF THE BID BOND IS NOT SIGNED BY THE PURPORTED SURETY ALTHOUGH EXECUTED BY A NOTARY PUBLIC. IN ADDITION, THE BID BOND IS SIGNED BY EDMUND D. MINNEY AND EUGENE B. JOHNSON, BUT THE REAL PROPERTY, LISTED IN THE AFFIDAVITS, IS OWNED, ACCORDING TO THE TAX BILLS, BY THE SURETIES AND THEIR WIVES, RAISING A QUESTION WHETHER THE REAL PROPERTY WAS ACTUALLY AVAILABLE FOR SURETY PURPOSES, WITHOUT THE SIGNATURES OF THE WIVES ON THE BOND. WE NOTE ALSO THAT, FOR THE SAME REASON, THE SIGNATURES OF THE WIVES SHOULD HAVE BEEN OBTAINED ON THE PAYMENT BOND. IT WOULD BE APPROPRIATE TO OBTAIN SUCH SIGNATURES ON THE PAYMENT BOND AT THIS TIME IF CORRECTIVE ACTION HAS NOT ALREADY BEEN TAKEN.
