WERE NOT MANUFACTURED ACCORDING TO SPECIFICATIONS. BECAUSE THE LOCKERS ARE IN A DISMANTLED CONDITION AN EXTENSIVE EXAMINATION WILL NOT BE CONDUCTED UNTIL ASSEMBLY AND INSTALLATION. INCORPORATED: REFERENCE IS MADE TO YOUR LETTER OF MARCH 23. UNDER PROJECT 09-5239 WERE NOT MANUFACTURED IN ACCORDANCE WITH THE SPECIFICATIONS. TO THE ARCHITECT ENGINEER AND THE SENIOR RESIDENT ENGINEER AND WERE RETURNED APPROVED AS BEING IN COMPLIANCE WITH THE CONTRACT SPECIFICATIONS. THE ASSISTANT ADMINISTRATOR ALSO ADVISED US THAT THE LOCKERS ARE NOW STORED ON THE CONSTRUCTION SITE IN A DISMANTLED CONDITION AND THAT WHILE THIS PREVENTS COMPLETE INSPECTION AT THIS TIME. THE SENIOR ENGINEER HAS STATED THAT HE HAS NO REASON TO BELIEVE THAT THE LOCKERS ARE NOT AS SPECIFIED.

CONTRACTS - SPECIFICATION COMPLIANCE - METAL LOCKERS CONCERNING ALLEGATIONS THAT METAL LOCKERS DELIVERED TO THE CONTRACTOR FOR INSTALLATION AT THE VA HOSPITAL TAMPA, FLORIDA, WERE NOT MANUFACTURED ACCORDING TO SPECIFICATIONS. BECAUSE THE LOCKERS ARE IN A DISMANTLED CONDITION AN EXTENSIVE EXAMINATION WILL NOT BE CONDUCTED UNTIL ASSEMBLY AND INSTALLATION.

TO LYON METAL PRODUCTS, INCORPORATED:

REFERENCE IS MADE TO YOUR LETTER OF MARCH 23, 1971, IN WHICH YOU ADVISE THAT METAL LOCKERS PRODUCED BY ANOTHER METAL PRODUCTS CONCERN AND DELIVERED TO THE GENERAL CONTRACTOR FOR INSTALLATION AT THE VETERANS ADMINISTRATION HOSPITAL, TAMPA, FLORIDA, UNDER PROJECT 09-5239 WERE NOT MANUFACTURED IN ACCORDANCE WITH THE SPECIFICATIONS.

BY LETTER DATED MAY 3, 1971, THE ASSISTANT ADMINISTRATOR FOR CONSTRUCTION, VETERANS ADMINISTRATION, ADVISED US THAT THE GENERAL CONTRACTOR FOR THE PROJECT SUBMITTED FOR REVIEW SHOP DRAWINGS AND CATALOG LITERATURE FOR THE LOCKERS ON JUNE 26, 1970, TO THE ARCHITECT ENGINEER AND THE SENIOR RESIDENT ENGINEER AND WERE RETURNED APPROVED AS BEING IN COMPLIANCE WITH THE CONTRACT SPECIFICATIONS. THE ASSISTANT ADMINISTRATOR ALSO ADVISED US THAT THE LOCKERS ARE NOW STORED ON THE CONSTRUCTION SITE IN A DISMANTLED CONDITION AND THAT WHILE THIS PREVENTS COMPLETE INSPECTION AT THIS TIME, THE SENIOR ENGINEER HAS STATED THAT HE HAS NO REASON TO BELIEVE THAT THE LOCKERS ARE NOT AS SPECIFIED.

WE ARE ASSURED THAT WHEN THE LOCKERS ARE ASSEMBLED AND INSTALLED, A FURTHER EXAMINATION WILL BE MADE TO DETERMINE SPECIFICATION COMPLIANCE. WE TRUST THAT THE FOREGOING SATISFIES THE PURPOSE OF YOUR INQUIRY.
