SECRETARY: ENCLOSED IS A COPY OF OUR DECISION OF TODAY. WHILE WE HAVE DENIED THE PROTEST. WE BELIEVE THAT THE NAVAL ORDNANCE STATION'S MESSAGE TRANSMISSION PROCEDURES SHOULD BE REVIEWED AND REVISED TO ELIMINATE THE POSSIBILITY THAT THE CIRCUMSTANCES PROMPTING THE PROTEST WILL RECUR IN THE FUTURE. IT IS OUR VIEW THAT IF TWX'S ARE GOING TO BE UTILIZED BY THE NAVAL ORDNANCE STATION IN THE CONDUCT OF NEGOTIATIONS. THE PROTEST WAS THE SUBJECT OF A LETTER.

ADVISES THAT THE NAVAL ORDNANCE STATION'S MESSAGE TRANSMISSION PROCEDURES BE REVISED TO MAKE CLEAR THAT TWX'S CANNOT BE RECEIVED.

TO MR. SECRETARY:

ENCLOSED IS A COPY OF OUR DECISION OF TODAY, DENYING THE PROTEST OF ZERO MANUFACTURING COMPANY AGAINST THE AWARD OF A CONTRACT TO F. & B. MANUFACTURING COMPANY UNDER REQUEST FOR PROPOSALS N00197-71-R-0007, ISSUED BY THE NAVAL ORDNANCE STATION, LOUISVILLE, KENTUCKY. WHILE WE HAVE DENIED THE PROTEST, WE BELIEVE THAT THE NAVAL ORDNANCE STATION'S MESSAGE TRANSMISSION PROCEDURES SHOULD BE REVIEWED AND REVISED TO ELIMINATE THE POSSIBILITY THAT THE CIRCUMSTANCES PROMPTING THE PROTEST WILL RECUR IN THE FUTURE. IN THIS CONNECTION, IT IS OUR VIEW THAT IF TWX'S ARE GOING TO BE UTILIZED BY THE NAVAL ORDNANCE STATION IN THE CONDUCT OF NEGOTIATIONS, OFFERORS SHOULD BE ADVISED THAT TWX RESPONSES CANNOT BE RECEIVED. WOULD APPRECIATE YOUR ADVICE AS TO THE REMEDIAL ACTION TAKEN.

THE PROTEST WAS THE SUBJECT OF A LETTER, WITH ENCLOSURES, OF FEBRUARY 19, 1971, FROM THE DEPUTY COMMANDER, PURCHASING, NAVAL SUPPLY SYSTEMS COMMAND, FURNISHING OUR OFFICE AN ADMINISTRATIVE REPORT.
