OUR OFFICE IS NOT IN A POSITION TO DETERMINE WHETHER THE PURCHASE DESCRIPTION USED IN THIS CASE IS TECHNICALLY ADEQUATE. WE RECOMMEND THAT YOUR DEPARTMENT DETERMINE WHETHER THERE IS ANY MERIT TO THE CONTENTION MADE BY DATAMETRICS CONCERNING THE INADEQUACY OF THE SPECIFICATION DUE TO THE LACK OF ANY ACCURACY REQUIREMENT FOR THE COMBINATION SENSOR AND METER.

REFERENCE IS MADE TO REPORTS DATED FEBRUARY 5, 1971, AND APRIL 13, 1971, AND ENCLOSURES, FROM THE CHIEF, CONTRACT MANAGEMENT DIVISION, DIR/PROCUREMENT POLICY, DCS/S&L, IN THE MATTER OF THE PROTEST OF THE DATAMETRICS DIVISION OF CGS SCIENTIFIC CORPORATION, UNDER INVITATION FOR BIDS NO. F41608-71-B-0076, ISSUED BY THE DIRECTORATE OF PROCUREMENT AND PRODUCTION, SAN ANTONIO AIR MATERIEL AREA, KELLY AIR FORCE BASE, TEXAS.

ENCLOSED IS A COPY OF OUR DECISION OF TODAY. WHILE WE ARE DENYING THE PROTEST FOR THE REASONS STATED IN OUR DECISION, WE NEVERTHELESS HAVE SOME CONCERN WITH THE ALLEGATION THAT THE COMBINATION SENSOR AND METER FAILED TO MEET PARAGRAPH 4 OF THE SPECIFICATION. IN RESPONDING TO THIS ALLEGATION, YOUR DEPARTMENT POINTED OUT THAT PARAGRAPH 4 (A REQUIREMENT FOR A CERTAIN PERCENTAGE OF ACCURACY) PERTAINED ONLY TO THE METER AND DID NOT APPLY TO THE SENSOR. AS CONTENDED TO US, HOWEVER, THIS APPEARS TO LEAVE THE COMBINATION SENSOR AND METER WITHOUT ANY REQUIREMENT FOR ACCURACY. WE ARE GIVEN TO UNDERSTAND INFORMALLY BY YOUR DEPARTMENT THAT PARAGRAPH 2 OF THE SENSOR PURCHASE DESCRIPTION, WHICH READS THAT "PERMANENTLY SEALED VACUUM REFERENCE TO AT LEAST 1 X 10-5 TORRS OR LESS", COVERS THE ACCURACY PROBLEM.

OBVIOUSLY, OUR OFFICE IS NOT IN A POSITION TO DETERMINE WHETHER THE PURCHASE DESCRIPTION USED IN THIS CASE IS TECHNICALLY ADEQUATE. BEFORE PROCEEDING WITH THE AWARD, WE RECOMMEND THAT YOUR DEPARTMENT DETERMINE WHETHER THERE IS ANY MERIT TO THE CONTENTION MADE BY DATAMETRICS CONCERNING THE INADEQUACY OF THE SPECIFICATION DUE TO THE LACK OF ANY ACCURACY REQUIREMENT FOR THE COMBINATION SENSOR AND METER.
