SECRETARY: ENCLOSED IS A COPY OF OUR DECISION OF TODAY TO THE COUNSEL FOR PREMIER ELECTRICAL CONSTRUCTION COMPANY RELATIVE TO ITS PROTEST AGAINST THE NAVAL FACILITIES ENGINEERING COMMAND'S AWARD OF A CONTRACT ON NOVEMBER 13. WE BELIEVE THAT IT IS DESIRABLE. PARTICULARLY WHEN "TURNKEY" NEGOTIATION PROCEDURES ARE EMPLOYED. THAT NONDISCLOSURE OF THE RELATIVE IMPORTANCE OF THE EVALUATION CRITERIA WAS IN ACCORDANCE WITH A MEMORANDUM DATED FEBRUARY 24. WE ARE BRINGING THIS MATTER TO THE ATTENTION OF THE SECRETARY OF DEFENSE.

ENCLOSED IS A COPY OF OUR DECISION OF TODAY TO THE COUNSEL FOR PREMIER ELECTRICAL CONSTRUCTION COMPANY RELATIVE TO ITS PROTEST AGAINST THE NAVAL FACILITIES ENGINEERING COMMAND'S AWARD OF A CONTRACT ON NOVEMBER 13, 1970, TO BURNS AND ROE CONSTRUCTION CORPORATION FOR THE DESIGN AND CONSTRUCTION (TURNKEY METHOD) OF 150 UNITS OF FAMILY HOUSING AT GUANTANAMO NAVAL BASE.

WHILE WE CONCLUDE THAT THE AWARD NEED NOT BE QUESTIONED, WE BELIEVE THAT IT IS DESIRABLE, IF NOT ESSENTIAL, PARTICULARLY WHEN "TURNKEY" NEGOTIATION PROCEDURES ARE EMPLOYED, THAT THE REQUEST FOR PROPOSALS ADVISE ALL OFFERORS OF THE RELATIVE IMPORTANCE OF THE CRITERIA TO BE USED IN THE EVALUATION OF OFFERS. WE RECOGNIZE, HOWEVER, THAT NONDISCLOSURE OF THE RELATIVE IMPORTANCE OF THE EVALUATION CRITERIA WAS IN ACCORDANCE WITH A MEMORANDUM DATED FEBRUARY 24, 1970, FROM THE DEPUTY ASSISTANT SECRETARY OF DEFENSE (INSTALLATIONS AND HOUSING), ENTITLED "ONE-STEP TURNKEY PROCEDURES FOR MILITARY FAMILY HOUSING PROJECTS." ACCORDINGLY, WE ARE BRINGING THIS MATTER TO THE ATTENTION OF THE SECRETARY OF DEFENSE.
