THE SECRETARY OF THE AIR FORCE: AS A RESULT OF ROUTINE INVESTIGATIONS AT VARIOUS AIR FORCE INSTALLATIONS BY EMPLOYEES OF THIS OFFICE THERE HAS BEEN BROUGHT TO MY ATTENTION THE FACT THAT PAYMENTS ARE BEING MADE TO SCHOOL DISTRICTS FOR SCHOOLING FURNISHED TO DEPENDENTS OF CERTAIN MILITARY AND CIVILIAN PERSONNEL WITHOUT AN EXPRESS FINDING BY THE SECRETARY OF THE AIR FORCE THAT SUCH SCHOOL DISTRICTS OTHERWISE ARE UNABLE TO PROVIDE ADEQUATELY FOR THE EDUCATION OF SUCH DEPENDENTS. THE AUTHORITY FOR SUCH PAYMENTS CURRENTLY IS CONTAINED IN SECTION 619 OF THE DEFENSE APPROPRIATION ACT. ARE UNABLE TO PROVIDE ADEQUATELY FOR THE EDUCATION OF SUCH DEPENDENTS ***.". IN THIS CONNECTION YOUR ATTENTION PARTICULARLY IS INVITED TO CONTRACT AF 48(012)-25 DATED DECEMBER 19.

THE HONORABLE, THE SECRETARY OF THE AIR FORCE:

AS A RESULT OF ROUTINE INVESTIGATIONS AT VARIOUS AIR FORCE INSTALLATIONS BY EMPLOYEES OF THIS OFFICE THERE HAS BEEN BROUGHT TO MY ATTENTION THE FACT THAT PAYMENTS ARE BEING MADE TO SCHOOL DISTRICTS FOR SCHOOLING FURNISHED TO DEPENDENTS OF CERTAIN MILITARY AND CIVILIAN PERSONNEL WITHOUT AN EXPRESS FINDING BY THE SECRETARY OF THE AIR FORCE THAT SUCH SCHOOL DISTRICTS OTHERWISE ARE UNABLE TO PROVIDE ADEQUATELY FOR THE EDUCATION OF SUCH DEPENDENTS.

THE AUTHORITY FOR SUCH PAYMENTS CURRENTLY IS CONTAINED IN SECTION 619 OF THE DEFENSE APPROPRIATION ACT, 1951, 64 STAT. 755, APPROVED SEPTEMBER 6, 1950, WHICH READS, IN PERTINENT PART AS FOLLOWS:

"APPROPRIATIONS FOR THE AIR FORCE AND THE ARMY FOR THE CURRENT FISCAL YEAR SHALL BE AVAILABLE *** FOR PRIMARY AND SECONDARY SCHOOLING FOR DEPENDENTS OF MILITARY AND CIVILIAN PERSONNEL OF THE DEPARTMENT OF DEFENSE RESIDING ON MILITARY INSTALLATIONS OR STATIONED IN FOREIGN COUNTRIES, BUT IN AMOUNTS NOT EXCEEDING $140 PER CHILD IN THE UNITED STATES, WHEN THE SECRETARY OF THE DEPARTMENT CONCERNED FINDS THAT SCHOOLS, IF ANY, AVAILABLE IN THE LOCALITY, ARE UNABLE TO PROVIDE ADEQUATELY FOR THE EDUCATION OF SUCH DEPENDENTS ***."

IN THIS CONNECTION YOUR ATTENTION PARTICULARLY IS INVITED TO CONTRACT AF 48(012)-25 DATED DECEMBER 19, 1949, WITH SCHOOL DISTRICT NO. 1, CHEYENNE, WYOMING. FROM THE RECORDS AVAILABLE TO THIS OFFICE IT APPEARS THAT THE ABOVE-MENTIONED CONTRACT WAS ENTERED INTO FOLLOWING THE RECEIPT OF A LETTER BY THE COMMANDING OFFICER, WARREN AIR BASE, DATED DECEMBER 14, 1949, FROM THE SUPERINTENDENT OF SCHOOLS, CHEYENNE, WYOMING, WHICH LETTER READS AS FOLLOWS:

"THE BOARD OF TRUSTEES OF SCHOOL DISTRICT NO. 1 HAS ALWAYS BEEN HAPPY TO ACCEPT THESE CHILDREN WITHOUT ANY PAYMENT OF TUITION. WE HAVE ALWAYS FELT THAT IT WAS OUR RESPONSIBILITY. WE HAVE TRIED TO DO THE BEST JOB WE COULD FOR THEM AND WE WANT THEM TO FEEL WELCOME IN OUR SCHOOLS.

"WE HAVE BEEN TOLD THAT THE FEDERAL GOVERNMENT MAKES AN APPROPRIATION BY WHICH TUITION CAN BE PAID FOR THESE CHILDREN UNDER CERTAIN CONDITIONS. WE ARE ELIGIBLE TO RECEIVE ANY MONEY UNDER SUCH CONDITIONS WE SHALL APPRECIATE YOUR LETTING US KNOW JUST WHAT THE SITUATION MAY BE. MAY I ASSURE YOU THAT IF NO MONEY IS AVAILABLE FOR THIS PROGRAM THAT THE SCHOOL AUTHORITIES WILL BE VERY HAPPY TO TAKE CARE OF THE CHILDREN ANYWAY. WANT THE PERSONNEL OF FT. WARREN TO FEEL WELCOME IN OUR TOWN AND THE SCHOOL AUTHORITIES WANT TO CONTRIBUTE TO THIS BY MAKING THE PEOPLE FEEL AT HOME IN OUR SCHOOLS AT ALL TIMES."

"I ASSURE YOU THAT ANY CONSIDERATION YOU MAY GIVE US WILL BE SINCERELY APPRECIATED."

IN VIEW OF THE FOREGOING, IT DOES NOT APPEAR THAT THE SCHOOLS IN THAT LOCALITY WERE UNABLE TO PROVIDE ADEQUATELY FOR THE EDUCATION OF THE DEPENDENTS INVOLVED NOR DOES IT APPEAR THAT ANY FINDING TO SUCH EFFECT HAS BEEN MADE BY THE SECRETARY OF THE AIR FORCE AS REQUIRED BY THE PROVISION OF LAW QUOTED ABOVE. BEFORE TAKING ANY FURTHER ACTION IN THE MATTER AN EXPRESSION OF YOUR VIEWS WITH RESPECT TO THE PROPRIETY OF THESE AND SIMILAR PAYMENTS MADE IN THE ABSENCE OF SUCH FINDINGS, WILL BE APPRECIATED.
