BID PROTEST - NEGOTIATIONS - BUY INDIAN ACT LETTER RECOMMENDING THAT THE SECRETARY OF THE INTERIOR INSURE THAT STANDARD PROCEDURES BE FOLLOWED IN FUTURE PROCUREMENTS SUBJECT TO THE "BUY INDIAN ACT."

ENCLOSED IS A COPY OF OUR DECISION OF TODAY, DENYING THE PROTEST OF R. & V. I. BARSTOW UNDER THE PROCUREMENT FOR COLLECTION AND DISPOSAL OF REFUSE AT THE BUREAU OF INDIAN AFFAIRS FACILITIES AT WINDOW ROCK AND FORT DEFIANCE, ARIZONA. THE PROTEST WAS THE SUBJECT OF REPORTS DATED OCTOBER 2 AND NOVEMBER 2, 1970, FROM YOUR ASSISTANT SECRETARY FOR ADMINISTRATION.

WHILE WE CANNOT SAY THAT THE IRREGULAR PROCEDURES FOLLOWED IN THIS PROCUREMENT CONFERRED AN UNFAIR COMPETITIVE ADVANTAGE ON EITHER OFFEROR, WE SUGGEST THAT ACTION BE TAKEN TO INSURE THAT CONTRACTING OFFICERS ARE FULLY INFORMED OF THE FORMS TO BE USED AND THE PROCEDURES TO BE FOLLOWED IN SOLICITING BIDS OR OFFERS AND AWARDING CONTRACTS IN FUTURE PROCUREMENTS SUBJECT TO THE BUY INDIAN ACT.
