B-168939, MAR. 18, 1970

TO MR. GEORGE N. HILL:

WE REFER TO YOUR VARIOUS LETTERS AND COMMUNICATIONS INCLUDING THOSE OF JANUARY 24, 1970; FEBRUARY 2, 1970; AND FEBRUARY 13, 1970, PERTAINING TO YOUR CLAIMS FOR A CHECK COVERING REFUND OF RETIREMENT DEDUCTIONS, PAYMENT FOR ACCUMULATED ANNUAL LEAVE, AND PAYMENT FOR DAMAGE TO YOUR EYEGLASSES AND KEY CHAIN HOLDER.

OUR LETTER TO YOU OF DECEMBER 23, 1969, POINTED OUT THAT YOUR CLAIM FOR DAMAGE TO YOUR EYEGLASSES AND KEY CHAIN HOLDER WAS IN THE NATURE OF A TORT ACTION. AS SUCH, WE HAVE NO JURISDICTION TO ADJUDICATE THE CLAIM. SINCE YOU STATED THAT THE DAMAGE OCCURRED IN THE SAN FRANCISCO MAIN POST OFFICE, WE SUGGESTED THAT YOU MIGHT WANT TO FILE YOUR CLAIM UNDER THE FEDERAL TORT CLAIMS ACT WITH THE POSTMASTER AT SAN FRANCISCO, WHICH APPARENTLY YOU DID.

IN OUR LETTER TO YOU OF JANUARY 20, 1970, COPY ENCLOSED, WE SET FORTH IN DETAIL THAT UNDER THE LAW NO FURTHER CONSIDERATION COULD BE GIVEN TO YOUR CLAIM FOR REFUND OF RETIREMENT DEDUCTIONS OR YOUR CLAIM FOR ACCUMULATED ANNUAL LEAVE.

YOUR COMMUNICATIONS MENTIONED ABOVE MERELY REPEAT DATA ALREADY ON RECORD AND DO NOT MERIT FURTHER CONSIDERATION. SIMILAR COMMENTS HEREAFTER RECEIVED FROM YOU WILL BE FILED WITHOUT REPLY.
