YOUR LETTER OF DECEMBER 23, 1969, REQUESTS RECONSIDERATION OF THE ACTION OF OUR CLAIMS DIVISION OF NOVEMBER 12, 1969, DENYING YOUR CLAIM FOR REIMBURSEMENT FOR EXPENSES YOU INCURRED INCIDENT TO DUTY PERFORMED AT BOGOTA, COLUMBIA, BETWEEN SEPTEMBER 13, 1967, AND AUGUST 2, 1968, AND INCIDENT TO YOUR CHANGE OF STATION TRAVEL FROM BOGOTA TO STOCKTON, CALIFORNIA.

YOU CLAIM REIMBURSEMENT FOR (1) COST OF TRANSPORTATION BETWEEN BOGOTA AND MELGAR, COLUMBIA, ON NUMEROUS OCCASIONS AND PER DIEM FOR PURPORTED INTERMITTENT TEMPORARY DUTY AT MELGAR DURING THE PERIOD DECEMBER 11, 1967, THROUGH JULY 12, 1968; (2) TEMPORARY QUARTERS SUBSISTENCE ALLOWANCE INCIDENT TO YOUR TRANSFER TO STOCKTON FROM BOGOTA; AND (3) THE COST OF ROUND-TRIP TRANSPORTATION BETWEEN STOCKTON AND BOGOTA AND PER DIEM FOR YOUR DEPENDENT DAUGHTER.

THE INITIAL OMISSION OF AUTHORIZATION OF TEMPORARY QUARTERS ALLOWANCE IN YOUR TRAVEL ORDERS OF JULY 12, 1968, MAY NOW BE CONSIDERED AS HAVING BEEN CORRECTED BY THE AMENDMENT OF OCTOBER 1, 1968, AND AN EXPLANATORY LETTER OF MARCH 2, 1970, FROM THE CIVILIAN PERSONNEL OFFICER AT SHARPE ARMY DEPOT. THE LETTER STATES THAT OMISSION OF THE AUTHORIZATION WAS AN ERROR AND THAT SUCH AUTHORIZATION HAD BEEN INTENDED. WE NOTE YOU HAVE SUBMITTED A RECEIPT FOR PAYMENT FOR "ROOM AND MEALS" FOR YOURSELF AND THREE DEPENDENTS IN A TOTAL AMOUNT OF $720 FOR THE PERIOD AUGUST 15, 1968, TO SEPTEMBER 20, 1968. THEREFORE, WE ARE INSTRUCTING OUR CLAIMS DIVISION TO ISSUE A SETTLEMENT IN YOUR FAVOR FOR $580, THE MAXIMUM AMOUNT ALLOWABLE FOR THE 30-DAY PERIOD UNDER SUBSECTION 2.5D (2) OF BUREAU OF THE BUDGET CIRCULAR NO. A-56. THE EXPENSES YOU LIST FOR AUGUST 1 AND 2, 1968, AT BOGOTA, COLUMBIA, HAVE NOT BEEN INCLUDED BECAUSE YOU DID NOT FURNISH AN ITEMIZATION THEREOF AS REQUIRED BY THE REGULATIONS. IN LIEU THEREOF WE HAVE ADDED TWO DAYS AT THE END OF THE PERIOD TO COMPLETE THE 30-DAY PERIOD WHICH BEGAN AT 1800 HOURS ON AUGUST 15, 1968.

WITH RESPECT TO THE ITEM FOR REIMBURSEMENT FOR REPEATED ROUND-TRIP TRANSPORTATION BETWEEN BOGOTA AND MELGAR AND FOR PER DIEM IN MELGAR, WE POINT OUT THAT THE QUESTION OF WHETHER YOUR HEADQUARTERS WAS BOGOTA OR MELGAR IS IMMATERIAL. THIS IS SO BECAUSE WE FIND NO AUTHORIZATION OR APPROVAL THEREOF AS REQUIRED UNDER SECTION 2 OF THE STANDARDIZED GOVERNMENT TRAVEL REGULATIONS. IN THAT CONNECTION THE MEMORANDUM OF JULY 3, 1968, TO YOU FROM THE CHIEF, ARMY SECTION, UNITED STATES MILITARY GROUP DISAPPROVING YOUR CLAIM AND THE RECOMMENDATION OF DISAPPROVAL OF YOUR CLAIM BY THE DEPARTMENT OF THE ARMY INDICATES THERE WAS NO INTENTION TO AUTHORIZE REIMBURSEMENT FOR THE TRAVEL BETWEEN BOGOTA AND MELGAR OR TO ALLOW PER DIEM IN LIEU OF SUBSISTENCE FOR THE TIME SPENT AT MELGAR. THUS, THE DISALLOWANCE OF THIS ITEM IS SUSTAINED.

AS TO THE ROUND-TRIP TRAVEL OF YOUR DAUGHTER BETWEEN STOCKTON, CALIFORNIA, AND BOGOTA, VOLUME 2, JTR C7002-9B PRECLUDES AUTHORIZATION OF TRAVEL OF DEPENDENTS TO AN OVERSEAS POST IF LESS THAN ONE YEAR REMAINS TO BE COMPLETED OF THE EMPLOYEE'S AGREED PERIOD OF SERVICE. IT IS OUR UNDERSTANDING YOU WERE ADVISED APPROXIMATELY JULY 8, 1968, THAT YOUR SERVICE AT BOGOTA WOULD BE TERMINATED ON OR ABOUT JULY 31, 1968. SINCE YOUR DAUGHTER DID NOT LEAVE STOCKTON UNTIL JULY 18, 1968, AND APPARENTLY HAD SUITABLE LIVING ACCOMMODATIONS THERE IT WOULD HAVE SEEMED REASONABLE UNDER THE CIRCUMSTANCES TO CANCEL HER PLANS FOR TRAVEL TO BOGOTA. FURTHER, WE NOTE YOU WERE ADVISED BY TELEGRAM FROM SHARPE ARMY DEPOT PRIOR TO YOUR DAUGHTER'S DEPARTURE THAT HER TRAVEL EXPENSES WOULD NOT BE PAID BY THE GOVERNMENT. ACCORDINGLY, THE DISALLOWANCE OF THIS ITEM LIKEWISE IS SUSTAINED.
