YOUR LETTER OF JANUARY 5, 1967, ADDRESSED TO MR. CLIFFORD E. WALSH, AN EMPLOYEE OF THE UNITED STATES GENERAL ACCOUNTING OFFICE, HAS BEEN REFERRED TO THIS OFFICE FOR CONSIDERATION AND ACTION.

THE LETTER PRESENTS YOUR CLAIM FOR DAMAGES TO YOUR 1965 CHEVROLET PICKUP TRUCK INCURRED IN A MULTIPLE-CAR ACCIDENT ON DECEMBER 22, 1969, INVOLVING, AMONG OTHERS, THE 1968 FORD SEDAN DRIVEN BY MR. WALSH.

BOTH THE POLICE DEPARTMENT REPORT OF THIS ACCIDENT, WHICH WE OBTAINED FROM THE SOUTH BRUNSWICK TOWNSHIP POLICE DEPARTMENT, AND THE ACCIDENT REPORT SUBMITTED BY MR. WALSH, AGREE THAT MR. WALSH'S CAR NEITHER STRUCK YOUR TRUCK NOR CAUSED ANY OTHER CAR INVOLVED THEREIN TO STRIKE YOUR TRUCK. THE RECORD BEFORE OUR OFFICE INDICATES THAT MR. WALSH ARRIVED AT THE SCENE OF THE ACCIDENT A SHORT TIME AFTER THE OCCURRENCE OF THE ORIGINAL SEVEN-CAR ACCIDENT DURING WHICH YOUR TRUCK WAS STRUCK AND DAMAGED AND, WHILE ATTEMPTING TO STOP TO AVOID A DAMAGED CAR PARTIALLY BLOCKING HIS LANE, SKIDDED ON THE ICE BUT, AS INDICATED ABOVE, DID NOT STRIKE YOUR TRUCK OR CAUSE ANOTHER CAR TO STRIKE IT.

IN VIEW THEREOF, THERE IS NO LEGAL BASIS FOR LIABILITY ON THEPART OF MR. WALSH FOR THE DAMAGE RECEIVED BY YOUR TRUCK, AND YOUR CLAIM IS HEREBY DENIED.
