DIVISION OF PROCUREMENT INTO ARBITRARY QUANTITIES WHILE IT WAS NOT FOUND THAT AWARDS MADE BY NAVAL AIR SYSTEMS COMMAND UNDER REQUEST FOR PROPOSALS NO. N00019-70-R-0062 WERE UNAUTHORIZED OR IMPROPER. IT IS POINTED OUT TO SECRETARY OF NAVY THAT. MORE FLEXIBLE PROCEDURE MIGHT HAVE BEEN PROVIDED BY REQUESTING OFFERS ON BASIS OF UNIT PRICES FOR INCREMENTAL OR STEPLADDER QUANTITIES. SECRETARY: ENCLOSED IS A COPY OF OUR DECISION OF TODAY DENYING THE PROTEST OF THE DEFENSE PRODUCTS DIVISION. WHICH WAS TRANSMITTED BY LETTER DATED MARCH 26. IS ALSO ENCLOSED. WHILE WE DID NOT FIND THAT THE AWARDS MADE WERE UNAUTHORIZED OR IMPROPER. IT WOULD APPEAR THAT A MORE FLEXIBLE PROCEDURE MIGHT HAVE BEEN PROVIDED BY REQUESTING OFFERS ON THE BASIS OF UNIT PRICES FOR INCREMENTAL OR STEPLADDER QUANTITIES.

ENCLOSED IS A COPY OF OUR DECISION OF TODAY DENYING THE PROTEST OF THE DEFENSE PRODUCTS DIVISION, VARO, INCORPORATED, AGAINST THE AWARD OF A CONTRACT TO ANY OTHER FIRM UNDER REQUEST FOR PROPOSALS NO. N00019-70 R- 0062. A FILE ON THE MATTER, WHICH WAS TRANSMITTED BY LETTER DATED MARCH 26, 1970 (AIR-OOC:GPQ/PML), FROM THE NAVAL AIR SYSTEMS COMMAND, IS ALSO ENCLOSED.

WHILE WE DID NOT FIND THAT THE AWARDS MADE WERE UNAUTHORIZED OR IMPROPER, WE WOULD LIKE TO OBSERVE THAT, IN THE ABSENCE OF ANY EXPLANATION OF THE DIVISION OF THE PROCUREMENT INTO APPARENTLY ARBITRARY QUANTITIES, IT WOULD APPEAR THAT A MORE FLEXIBLE PROCEDURE MIGHT HAVE BEEN PROVIDED BY REQUESTING OFFERS ON THE BASIS OF UNIT PRICES FOR INCREMENTAL OR STEPLADDER QUANTITIES.
