SPECIFICATIONS--FAILURE TO FURNISH SOMETHING REQUIRED--INFORMATION CONCERNING DENIED PROTEST AGAINST PROCUREMENT ACTION OF GENERAL CONCERNING DENIED PROTEST AGAINST PROCUREMENT ACTION OF GENERAL SERVICES ADMINISTRATION (GSA), IT HAS BEEN CONCLUDED, IN AGREEMENT WITH POSITION OF GSA GENERAL COUNSEL, THAT FAILURE TO INCLUDE INFORMATION APPARENTLY REQUIRED BY TERMS OF INVITATION FOR BIDS (IFB) DID NOT RENDER LOW BID NONRESPONSIVE WHERE INFORMATION DID NOT CONTRIBUTE MATERIALLY TO BID EVALUATION; HOWEVER, IT IS RECOMMENDED THAT GSA UNDERTAKE REVIEW OF REQUESTS FOR INFORMATION IN IFB WITH VIEW TO ELIMINATING THOSE WHICH ARE NOT NECESSARY OR WHICH MAY BE AS READILY SATISFIED AFTER AWARD, BECAUSE SUCH CALLS FOR INFORMATION WILL UNDOUBTEDLY CONTINUE TO COMPLICATE AWARD PROCEDURE.

REFERENCE IS MADE TO LETTER DATED SEPTEMBER 30, 1969, WITH ENCLOSURES, FROM YOUR GENERAL COUNSEL, CONCERNING THE PROTEST OF SHELBY WILLIAMS INDUSTRIES, INCORPORATED, AGAINST THE PROCUREMENT ACTION OF GENERAL SERVICES ADMINISTRATION IN CONNECTION WITH INVITATION FOR BIDS NO. FPNFH-A -27783.

THERE IS ENCLOSED A COPY OF OUR DECISION OF TODAY DENYING THE PROTEST.
