WAS BEING SUSPENDED BY OUR AGREEING TO PERMIT THE FOREST SERVICE TO EXERCISE EXISTING ONE-YEAR CONTRACT OPTIONS TO MAINTAIN THE CURRENT COMPOSITION OF AIR TANKER CONTRACTORS FOR THE 1971 FIRE SEASON ONLY. THE FOREST SERVICE WILL BE REQUIRED TO IMPLEMENT THE DECISION BY REQUIRING THE SUBMISSION OF PROPOSALS WHICH INCLUDE PRICE OR COST ESTIMATES COMMENCING WITH THE PROCUREMENT OF AIR TANKER SERVICES FOR THE 1972 FIRE SEASON. WHICH WERE BEFORE OUR OFFICE PRIOR TO THE ISSUANCE OF OUR DECISION. YOU STATE THAT "IT IS NOT CLEAR TO US FROM YOUR LETTER WHETHER THE SUSPENSION REFERRED TO AFFECTS THE CONTRACTS FOR ALL AIR TANKER BASES.

CONTRACTS - AIR TANKER SERVICES - EFFECTIVE DATE OF DECISION IN A PREVIOUS LETTER, GAO SUSPENDED THE EFFECTIVE DATE OF ITS DECISION B- 167003, B-167259, AND B-167846, AUGUST 19, 1970, 50 COMP. GEN. BY AN AGREEMENT TO PERMIT THE FOREST SERVICE TO EXERCISE EXISTING ONE-YEAR CONTRACT OPTIONS FOR AIR TANKER CONTRACTORS FOR THE 1971 FIRE SEASON. THE SUSPENSION AFFECTS ALL EXISTING FOREST SERVICE AIR TANKER CONTRACTS AND WAS TO HAVE SERVICE-WIDE APPLICATION.

WE ARE IN RECEIPT OF YOUR LETTER DATED JANUARY 5, 1971, REQUESTING THAT OUR OFFICE CLARIFY CERTAIN ASPECTS OF OUR LETTER TO YOU OF DECEMBER 28, 1970, WHEREIN WE INFORMED YOU THAT THE EFFECTIVE DATE OF OUR DECISION B- 167003, B-167259, B-167846, AUGUST 19, 1970, 50 COMP. GEN.

WAS BEING SUSPENDED BY OUR AGREEING TO PERMIT THE FOREST SERVICE TO EXERCISE EXISTING ONE-YEAR CONTRACT OPTIONS TO MAINTAIN THE CURRENT COMPOSITION OF AIR TANKER CONTRACTORS FOR THE 1971 FIRE SEASON ONLY. HOWEVER, THE FOREST SERVICE WILL BE REQUIRED TO IMPLEMENT THE DECISION BY REQUIRING THE SUBMISSION OF PROPOSALS WHICH INCLUDE PRICE OR COST ESTIMATES COMMENCING WITH THE PROCUREMENT OF AIR TANKER SERVICES FOR THE 1972 FIRE SEASON.

CITING PROTESTS OF YOUR CLIENT, AVIATION SPECIALTIES, INC., INVOLVING 3 AIR TANKER BASES, WHICH WERE BEFORE OUR OFFICE PRIOR TO THE ISSUANCE OF OUR DECISION, YOU STATE THAT "IT IS NOT CLEAR TO US FROM YOUR LETTER WHETHER THE SUSPENSION REFERRED TO AFFECTS THE CONTRACTS FOR ALL AIR TANKER BASES, INCLUDING THOSE DIRECTLY INVOLVED IN THESE PROTESTS, OR ONLY THOSE BASES WHICH WERE NOT DIRECTLY INVOLVED." THIS IS TO ADVISE THAT THE SUSPENSION OF THE EFFECTIVE DATE OF OUR DECISION OF AUGUST 19, 1970, WAS INTENDED TO APPLY TO ALL EXISTING FOREST SERVICE AIR TANKER CONTRACTS, AND, AS SUCH, WAS CONSIDERED TO BE DISPOSITIVE OF ALL PENDING PROTESTS ON THE MATTER BEFORE OUR OFFICE. THEREFORE, WE VIEW OUR SUSPENSION OF THE EFFECTIVE DATE OF THAT DECISION TO HAVE SERVICE WIDE APPLICATION TO ALL EXISTING AIR TANKER CONTRACTS, WITHOUT EXCEPTION.
