CIVIL PAY - SICK LEAVE - RECREDIT DECISION TO ACCOUNTABLE OFFICER OF GENERAL SERVICES ADMINISTRATION CONCERNING RECREDIT OF SICK LEAVE INCIDENT TO TRANSFER OF EMPLOYEE FROM POST OFFICE DEPARTMENT TO CIVIL SERVICE COMMISSION. IN VIEW OF EVIDENCE OF RECORD CORRECTIVE ACTIONS ARE AUTHORIZED.

WE REFER AGAIN TO YOUR LETTER OF OCTOBER 29, 1968 (3BCPA), AND LETTER OF APRIL 1, 1969, FROM OUR CLAIMS DIVISION CONCERNING THE RECREDIT OF SICK LEAVE IN MR. IMPELLIZERI'S CASE.

ON JUNE 20, 1969, WE RECEIVED THE FOLLOWING TELEFAX FROM MR. IMPELLIZERI: "REFERENCE MY APPEAL TELEGRAM OF 6/2/69 RE CLAIM Z23667534 ROBERT DRUMOND REGIONAL DIRECTOR USCSC NEW YORK ADVISED ME TODAY THAT USCSC WASH DC HAS DEFINITE INVESTIGATIONS REPORT RECORD DATED 1/15/48 SHOWING I HAD 52 DAYS 5 HOURS SICK LEAVE TO MY CREDIT WHEN I TRANSFERRED FROM PO DEPT TO USCSC ON 2/2/48 VERIFY THROUGH PEARL G BUCK BUREAU OF PERSONNEL INVESTIGATIONS USCSC BUILDING 19TH AND E ST NW. THIS LEAVE WAS NOT TRANSFERRED BECAUSE THE TWO SYSTEMS WERE THEN NOT COMPATIBLE. IT HAS NEVER BEEN CREDITED SINCE I LEFT THE PO DEPT AND I ASK THAT IT BE CREDITED NOW"

WE HAVE CONFERRED INFORMALLY WITH THE BUREAU OF PERSONNEL INVESTIGATIONS, UNITED STATES CIVIL SERVICE COMMISSION, AND HAVE BEEN ADVISED THAT THE COMMISSION DOES HAVE AN INVESTIGATION REPORT, MADE AT THE APPROXIMATE TIME OF THE TRANSFER OF MR. IMPELLIZERI TO THE COMMISSION ON FEBRUARY 2, 1948, WHICH REPORT DISCLOSES THAT AS OF THAT TIME HE HAD TO HIS CREDIT 52 DAYS AND 5 HOURS SICK LEAVE. BASED UPON THE INFORMATION CONTAINED IN SUCH REPORT IT NOW APPEARS THAT MR. IMPELLIZERI SHOULD HAVE HAD 52 DAYS AND 5 HOURS (421 HOURS) SICK LEAVE AVAILABLE TO HIM IMMEDIATELY PRIOR TO HIS SEPARATION ON APRIL 30, 1968. WE UNDERSTAND THAT MR. IMPELLIZERI WAS GRANTED 135 HOURS SICK LEAVE PRIOR TO THE TIME THAT THE CREDITING AND GRANTING OF SUCH LEAVE WAS QUESTIONED ADMINISTRATIVELY. ALSO, WE HAVE BEEN ADVISED INFORMALLY BY REPRESENTATIVES OF THE GENERAL SERVICES ADMINISTRATION THAT FROM MARCH 24 THROUGH APRIL 30, 1968, MR. IMPELLIZERI WAS CARRIED IN A LWOP STATUS.

ON THE PRESENT RECORD IT APPEARS THAT THE SICK LEAVE WHICH HAS NOT BEEN CREDITED TO MR. IMPELLIZERI'S ACCOUNT TOTALS 286 HOURS. ACCORDINGLY, THE FOLLOWING CORRECTIVE ACTIONS APPEAR WARRANTED:

(1) SUBSTITUTE SICK LEAVE FOR THE PERIOD OF LWOP EXTENDING FROM MARCH 24 - APRIL 30, 1968 (216 HOURS), AND

(2) EXTEND MR. IMPELLIZERI'S SEPARATION DATE TO GRANT THE BALANCE (70 HOURS) OF THE UNCREDITED SICK LEAVE. THE CIVIL SERVICE COMMISSION SHOULD BE ADVISED OF THE EXTENDED SEPARATION DATE SO THAT NECESSARY RETIREMENT ANNUITY ADJUSTMENTS MAY BE MADE.
