B-165514, MAY 16, 1969

TO MR. DRIVER:

WE REFER TO THE DEBT OF DR. CHARLES C. ADAMS IN THE AMOUNT OF $34,354, WHICH AROSE FROM ERRONEOUS PAYMENTS OF SALARY WHICH WERE MADE TO HIM AS AN EMPLOYEE OF THE VETERANS ADMINISTRATION HOSPITAL, MURFREESBORO, TENNESSEE, DURING THE PERIOD JULY 1960 THROUGH AUGUST 1968. THIS MATTER WAS THE SUBJECT OF YOUR REPORT TO US DATED APRIL 29, 1969.

THE OVERPAYMENTS OF SALARY RESULTED FROM AN ADMINISTRATIVE ERROR BY REASON OF WHICH THE AMOUNT OF DR. ADAM'S CIVIL SERVICE ANNUITY ALLOCABLE TO THE PERIOD OF HIS REEMPLOYMENT WAS NOT DEDUCTED FROM THE PAY HE RECEIVED DURING SUCH REEMPLOYMENT AS REQUIRED BY 5 U.S.C. 8344 (A).

UNDER THE AUTHORITY CONFERRED BY PUBLIC LAW 90-616 OF OCTOBER 21, 1968, 82 STAT. 1212, 5 U.S.C. 5584, AND UPON CONSIDERATION OF THE FACTS YOU HAVE SUBMITTED TO US SURROUNDING THE OVERPAYMENTS, WE HEREBY WAIVE THE CLAIM OF THE UNITED STATES AGAINST DR. ADAMS FOR THE OVERPAYMENTS MADE ON AND AFTER JULY 1, 1960. THE ADMINISTRATION SHOULD ADVISE HIM OF OUR ACTION.
