THIS REFERS TO YOUR CLAIM FOR PAYMENT OF UNPAID COMPENSATION ($40.52) DUE UNDER 5 U.S.C. 5582 AS THE WIDOW OF BENJAMIN B. WILLIAMS, A FORMER EMPLOYEE OF THE MARINE CORPS RECRUIT DEPOT, SAN DIEGO, CALIFORNIA.

YOUR CLAIM WAS DISALLOWED BY OUR OFFICE SETTLEMENT OF NOVEMBER 13, 1967, FOR THE REASON THAT YOU HAD NOT SUFFICIENTLY ESTABLISHED THAT YOUR CLAIM WAS SUPERIOR TO THAT OF MRS. ALICE V. WILLIAMS WHO ALSO HAD FILED A CLAIM AS WIDOW OF BENJAMIN B. WILLIAMS.

ON JANUARY 28, 1969, THE OFFICE OF FEDERAL EMPLOYEES' GROUP LIFE INSURANCE FURNISHED US WITH A COPY OF THE AGREEMENT AND RELEASE EXECUTED BY AND BETWEEN YOU AND ALICE V. WILLIAMS ON JANUARY 7, 1969. THAT DOCUMENT READS IN PART AS FOLLOWS:

"IT IS FURTHER UNDERSTOOD AND AGREED BY AND BETWEEN THE PARTIES THAT, IN CONSIDERATION OF THE AFORESAID PAYMENT OF FIFTEEN HUNDRED DOLLARS ($1,500.00), THE SAID PEARL WILLIAMS DOES HEREBY RELEASE ANY AND ALL OTHER RIGHT, TITLE AND INTEREST WHICH SHE HAS IN THE ESTATE OF BENJAMIN BRATTON WILLIAMS BY VIRTUE OF BEING HIS PUTATIVE WIFE TO ALICE V. WILLIAMS, IT BEING THE INTENT OF THIS INSTRUMENT TO BE CONSTRUED NOT ONLY AS A COMPLETE AND ABSOLUTE RELEASE BY PEARL WILLIAMS BUT ALSO AN ASSIGNMENT TO ALICE V. WILLIAMS OF ANY RIGHT, TITLE AND INTEREST WHICH SHE MAY HAVE IN THE ESTATE OF BENJAMIN BRATTON WILLIAMS, DECEASED, EXCEPT AS TO PROPERTY ALREADY RECEIVED BY PEARL WILLIAMS TO THIS DATE.'

IN VIEW THEREOF WE ARE AUTHORIZING PAYMENT OF THE AMOUNT DUE UNDER THE PROVISIONS OF 5 U.S.C. 5582 TO ALICE V. WILLIAMS, AS WIDOW OF BENJAMIN B. WILLIAMS.
