SINCE COST OF TRAVEL BY PRIVATELY-OWNED AUTO IS LESS THAN CONSTRUCTIVE COST BY COMMON CARRIER DIFFERENCE MAY BE ALLOWED. REPRESENTING THE DIFFERENCE BETWEEN THE MILEAGE HE WAS ALLOWED FOR USE OF HIS PRIVATELY OWNED VEHICLE AND CONSTRUCTIVE TAXICAB FARES AT HIS TEMPORARY DUTY STATION. GILLAM WAS ADMINISTRATIVELY ALLOWED ($91.20) ROUND TRIP TRAVEL BY AIR AND TAXICAB FARES. WITH THE EXCEPTION OF CONSTRUCTIVE TAXICAB FARES AT HIS TEMPORARY DUTY STATION IN LIEU OF WHICH HE WAS ALLOWED MILEAGE AT $0.10 PER MILE FOR 40 MILES.

EMPLOYEE WHO WAS NOT ALLOWED TAXICAB FARES AT TEMPORARY DUTY STATION IN COMPUTATION OF CONSTRUCTIVE TRAVEL COSTS WHEN HE USED PRIVATELY OWNED VEHICLE MAY BE ALLOWED MILEAGE BETWEEN EMPLOYEE'S RESIDENCE AND TEMPORARY DUTY STATION AND RETURN AT 12 CENTS PER MILE AS WELL AS MILEAGE AT TEMPORARY DUTY STATION PLUS TOLLS AND, THEREFORE, SINCE COST OF TRAVEL BY PRIVATELY-OWNED AUTO IS LESS THAN CONSTRUCTIVE COST BY COMMON CARRIER DIFFERENCE MAY BE ALLOWED.

YOUR LETTER OF DECEMBER 6, 1967, SUBMITS THE RECLAIM VOUCHER OF DR. W. S. GILLAM FOR $5, REPRESENTING THE DIFFERENCE BETWEEN THE MILEAGE HE WAS ALLOWED FOR USE OF HIS PRIVATELY OWNED VEHICLE AND CONSTRUCTIVE TAXICAB FARES AT HIS TEMPORARY DUTY STATION.

DR. GILLAM'S TRAVEL ORDER AUTHORIZED TRANSPORTATION BY PRIVATELY OWNED VEHICLE AT $0.12 PER MILE BETWEEN WASHINGTON, D.C., AND WRIGHTSVILLE BEACH, NORTH CAROLINA, AND RETURN, FOR THE PERIOD SEPTEMBER 17 TO 22, 1967, THE COST THEREOF NOT TO EXCEED THE COST OF TRANSPORTATION BY COMMON CARRIER.

IN DETERMINING THE CONSTRUCTIVE COST OF THE TRANSPORTATION BY COMMON CARRIER DR. GILLAM WAS ADMINISTRATIVELY ALLOWED ($91.20) ROUND TRIP TRAVEL BY AIR AND TAXICAB FARES, WITH THE EXCEPTION OF CONSTRUCTIVE TAXICAB FARES AT HIS TEMPORARY DUTY STATION IN LIEU OF WHICH HE WAS ALLOWED MILEAGE AT $0.10 PER MILE FOR 40 MILES. THE USE OF TAXICABS AT HIS TEMPORARY DUTY STATION HAS NOW BEEN APPROVED AS ADVANTAGEOUS TO THE GOVERNMENT AS REQUIRED BY SECTION 3.4A OF THE STANDARDIZED GOVERNMENT TRAVEL REGULATIONS AND MAY NOW BE REGARDED AS PROPER FOR CONSIDERATION IN DETERMINING WHETHER TRAVEL BY COMMON CARRIER WAS MORE ECONOMICAL THAN TRAVEL BY PRIVATELY OWNED AUTOMOBILE.

BY ALLOWING CREDIT FOR TAXI FARES THAT WOULD HAVE BEEN INCURRED AT THE TEMPORARY DUTY STATION HAD TRAVEL BEEN PERFORMED BY COMMON CARRIER, WE COMPUTE THE COST BY THAT MODE OF TRANSPORTATION AS AMOUNTING TO $96.20. IN COMPUTING THE COST OF TRAVEL BY PRIVATELY OWNED VEHICLE THERE IS FOR CONSIDERATION MILEAGE AT $0.12 PER MILE BETWEEN THE EMPLOYEE'S RESIDENCE AND TEMPORARY DUTY STATION AND RETURN, MILEAGE AT THE TEMPORARY DUTY STATION, AND TOLLS OF $1.80, OR A TOTAL OF $95.64. THE COST OF TRAVEL BY PRIVATELY OWNED AUTOMOBILE ON A MILEAGE BASIS BEING LESS THAN CONSTRUCTIVE TRAVEL BY COMMON CARRIER, DR. GILLAM SHOULD HAVE BEEN REIMBURSED FOR THE USE OF HIS PRIVATELY OWNED AUTOMOBILE IN THE AMOUNT OF $95.64. SINCE HE ONLY RECEIVED $91.20 FOR SUCH TRANSPORTATION, THE DIFFERENCE OF $4.44 APPEARS PROPER FOR PAYMENT.

ACCORDINGLY, THE VOUCHER WHICH IS RETURNED HEREWITH MAY BE CERTIFIED FOR PAYMENT IN THE AMOUNT OF $4.44.
