THIS REFERS TO LETTER OF OCTOBER 5, 1967, WITH ENCLOSURES, FROM MR. TOM KOUZES, DIRECTOR, OFFICE OF FINANCIAL MANAGEMENT AND AUDIT, ENCLOSING A RECLAIM VOUCHER FOR $465 IN FAVOR OF MR. RICHARD L. ECORD, AN EMPLOYEE OF THE DEPARTMENT OF LABOR, INCIDENT TO HIS TRANSFER OF PERMANENT STATION FROM GREENVILLE, MISSISSIPPI, TO OPELIKA, ALABAMA.

MR. ECORD INCURRED EXPENSES OF $215 FOR DISASSEMBLING HIS HOUSE TRAILER AT GREENVILLE BY JOE'S TRAILER SALES AND $250 FOR ASSEMBLING IT AT OPELIKA BY BREWERS MOBILE HOME PARTS AND SERVICE.

SECTION 9.3A (3) OF BUREAU OF THE BUDGET CIRCULAR NO. A-56, REVISED OCTOBER 12, 1966, READS AS FOLLOWS:

"/3) ALLOWANCES SHALL NOT INCLUDE COSTS OF PREPARING TRAILERS FOR MOVEMENT, MAINTENANCE, REPAIRS, STORAGE, INSURANCE FOR VALUATION OF TRAILERS ABOVE CARRIERS' MAXIMUM RESPONSIBILITY, NOR CHARGES DESIGNATED IN THE TARIFFS AS -SPECIAL SERVICE.-"

THE INFORMATION OF RECORD SHOWS THAT THE HOUSE TRAILER WAS MOVED BY THE TRANSIT HOMES INC. THE APPLICABLE TARIFF INVOLVED IS THE MOBILE HOUSING CARRIERS CONFERENCE, INC., AGENT, FREIGHT TARIFF NO. 10-B, MF I.C.C. NO. 14, EFFECTIVE OCTOBER 1, 1966. RULE 170 THEREOF, SPECIAL SERVICES, INCLUDES SUCH SPECIAL SERVICES AS "ASSEMBLE OR DISASSEMBLE TRAILER OR ADDITIONS THERETO.'

THEREFORE, WE ARE OF THE OPINION THAT THE CHARGES FOR ASSEMBLING AND DISASSEMBLING OF THE HOUSE TRAILER IN CONNECTION WITH THE MOVE MUST BE CONSIDERED AS CHARGES FOR PREPARING THE TRAILER FOR MOVEMENT OR "SPECIAL SERVICE" CHARGES REIMBURSEMENT OF WHICH ARE PRECLUDED BY SECTION 9.3A (3) OF CIRCULAR NO. A-56. SEE B-156315, DATED APRIL 9, 1965, 44 COMP. GEN. 619; B-156315 DATED JULY 21, 1966; AND B-160630, DATED JANUARY 23, 1967 (COPIES ENCLOSED).

ACCORDINGLY, THE VOUCHER WHICH IS RETURNED HEREWITH MAY NOT BE CERTIFIED FOR PAYMENT.
