WHERE INVITATION FOR STENOGRAPHIC REPORTING SERVICES FOR POST OFFICE DEPARTMENT WAS ISSUED TO 8 FIRMS POSTED IN BUILDING AND SYNOPSIZED IN COMMERCE BUSINESS DAILY, FAILURE OF DEPT. TO MAIL COPY TO POTENTIAL BIDDER DOES NOT PROVIDE SUFFICIENT BASIS FOR REJECTION OF ALL BIDS AND READVERTISEMENT SINCE THERE WAS SUFFICIENT NOTICE TO GENERATE COMPETITION.

REFERENCE IS MADE TO YOUR LETTER OF SEPTEMBER 12, 1967, PROTESTING THAT YOUR COMPANY WAS NOT SOLICITED TO BID ON POST OFFICE DEPARTMENT INVITATION FOR BIDS 51 DESPITE A PREVIOUS REQUEST TO BE PLACED ON THE MAILING LIST FOR INVITATIONS FOR STENOGRAPHIC REPORTING.

THE POST OFFICE DEPARTMENT HAS REPORTED TO US THAT A THOROUGH SEARCH HAS BEEN MADE OF ITS FILES AND THERE IS NO RECORD OF RECEIPT FROM YOUR COMPANY OF STANDARD FORM 129, BIDDER'S MAILING LIST APPLICATION, NOR DOES ANYONE IN THE DEPARTMENT HAVE A RECOLLECTION THAT YOUR COMPANY SUBMITTED A FORM 129.

IT IS REPORTED FURTHER THAT THE INVITATION WAS ISSUED TO EIGHT FIRMSON AUGUST 25; THAT A COPY OF THE INVITATION WAS POSTED IN THE POST OFFICE DEPARTMENT BUILDING, AND THAT A NOTICE OF THE INVITATION WAS PUBLISHED IN THE COMMERCE BUSINESS DAILY ON SEPTEMBER 6, 1967.

TWO BIDS WERE RECEIVED UNDER THE INVITATION AND WERE OPENED ON SEPTEMBER 11, 1967. THE POST OFFICE REPORTS THAT THE SPECIFIC INTEREST OF YOUR COMPANY WAS NOT KNOWN UNTIL AFTER BIDS HAD BEEN OPENED, AT WHICH TIME YOU REQUESTED A COPY OF THE INVITATION AND INQUIRED AS TO THE RESULTS OF THE BIDDING.

IN ANY EVENT, THERE APPEARS TO HAVE BEEN A SUFFICIENT CIRCULARIZATION OF THE INVITATION TO GENERATE COMPETITION, AND BIDS HAVE BEEN RECEIVED AND PUBLICLY DISCLOSED. OUR OFFICE HELD IN 34 COMP. GEN. 684 THAT THE FAILURE TO MAIL A COPY OF AN INVITATION TO A PROSPECTIVE BIDDER DOES NOT PROVIDE A SUFFICIENT BASIS TO REQUIRE THE REJECTION OF ALL BIDS AND READVERTISEMENT OF THE PROCUREMENT.
