WE REFER TO YOUR LETTER OF JUNE 8, 1967, REQUESTING OUR ADVANCE DECISION WHETHER YOU MAY PROPERLY CERTIFY FOR PAYMENT THE ENCLOSED TRAVEL VOUCHER OF MR. LLOYD A. TATUM, AN EMPLOYEE OF THE POST OFFICE DEPARTMENT, SAN MATEO, CALIFORNIA, FOR REIMBURSEMENT OF CERTAIN EXPENSE HE INCURRED INCIDENT TO HIS TRANSFER FROM IDAHO FALLS, IDAHO, TO SAN MATEO IN JULY 1966.

MR. TATUM WHO HAD BEEN EMPLOYED BY THE ATOMIC ENERGY COMMISSION IN IDAHO FALLS ACCEPTED A POSITION WITH THE POST OFFICE DEPARTMENT IN SAN MATEO EFFECTIVE JULY 3, 1966. HE WAS APPOINTED TO THE POST OFFICE POSITION BEFORE HE LEFT IDAHO FALLS AND WAS IMMEDIATELY GRANTED ANNUAL LEAVE FROM THE DATE OF HIS APPOINTMENT THROUGH JULY 22. HE DID NOT LEAVE IDAHO FALLS TO TRAVEL TO SAN MATEO UNTIL JULY 23.

YOU QUESTION WHETHER MR. TATUM MAY BE ALLOWED THE BENEFITS PROVIDED FOR TRANSFERRED EMPLOYEES BY THE ACT OF JULY 21, 1966, PUB. L. 89-516, 80 STAT. 323, IN VIEW OF THE FACT THAT HIS APPOINTMENT TO THE POST OFFICE DEPARTMENT POSITION IN SAN MATEO OCCURRED PRIOR TO THE EFFECTIVE DATE OF THAT ACT.

THE COVERING LETTER OF THE REGULATIONS IMPLEMENTING PUB. L. 89-516, BUREAU OF THE BUDGET CIRCULAR NO. A-56, REVISED OCTOBER 12, 1966, PROVIDES THAT THE BENEFITS OF THE ACT WILL BE ALLOWABLE TO TRANSFERRED EMPLOYEES WHO REPORTED FOR DUTY AT THEIR NEW OFFICIAL STATION ON OR AFTER JULY 21, 1966, AND THAT THE EXPENSES WHICH ARE REIMBURSABLE UNDER THAT ACT MAY BE PAID ONLY IF THEY WERE INCURRED ON OR AFTER JULY 21.

THE REPORTING FOR DUTY REQUIREMENT OF THAT REGULATION HAS BEEN INTERPRETED AS REFERRING TO THE DAY THE EMPLOYEE PHYSICALLY REPORTS FOR WORK AT HIS NEW DUTY STATION. B-161266, MAY 1, 1967 (COPY ENCLOSED). SINCE MR. TATUM DID NOT PHYSICALLY REPORT FOR DUTY IN SAN MATEO UNTIL JULY 25 HE IS ENTITLED TO REIMBURSEMENT OF EXPENSES AS PROVIDED BY PUB. L. 89- 516 AND BUREAU OF THE BUDGET CIRCULAR NO. A-56.

REGARDING THE CLAIM FOR REIMBURSEMENT OF ACTUAL EXPENSES WHILE OCCUPYING TEMPORARY QUARTERS ($782.30) SUBSECTION 2.5D(1) OF BUREAU OF THE BUDGET CIRCULAR NO. A-56 REQUIRES THAT THE ACTUAL EXPENSES CLAIMED BE SUPPORTED AS PROVIDED IN SUBSECTION 6.12F OF THE STANDARDIZED GOVERNMENT TRAVEL REGULATIONS AS FOLLOWS:

"ITEMIZATION OF, AND RECEIPT FOR, EXPENSES. - ACTUAL AND NECESSARY SUBSISTENCE EXPENSES INCURRED ON A TRAVEL ASSIGNMENT FOR WHICH REIMBURSEMENT IS CLAIMED BY A TRAVELER WILL BE ITEMIZED IN A MANNER PRESCRIBED BY THE HEADS OF DEPARTMENTS AND ESTABLISHMENTS WHICH WILL PERMIT AT LEAST A REVIEW OF THE AMOUNTS SPENT DAILY FOR (1) LODGING, (2) MEALS, AND (3) ALL OTHER ITEMS OF SUBSISTENCE EXPENSES. RECEIPTS WILL BE REQUIRED AT LEAST FOR LODGING."

PRIOR TO CERTIFYING THIS ITEM FOR PAYMENT YOU SHOULD OBTAIN APPROPRIATE SUPPORT FOR THE EXPENDITURES CLAIMED BY MR. TATUM.

THE VOUCHER WHICH IS RETURNED HEREWITH MAY BE CERTIFIED FOR PAYMENT IN ACCORDANCE WITH THE ABOVE IF OTHERWISE CORRECT.
