ADAMSON'S CLAIM WAS ACCOMPANIED BY A COPY OF A DECREE OF DIVORCE DATED DECEMBER 7. THERE WAS CERTIFIED FOR PAYMENT TO NORA B. THE SETTLEMENT IS IN ACCORD WITH OUR LONG ESTABLISHED PRACTICE IN DISPOSING OF SMALL AMOUNTS DUE UNDER THE ACT OF AUGUST 3. WAS RECEIVED IN OUR OFFICE ON OCTOBER 10. WHILE NORMALLY PREFERENTIAL RECOGNITION WOULD BE ACCORDED A COURT APPOINTED GUARDIAN OVER A NATURAL GUARDIAN OR CUSTODIAN OF A MINOR WHEN THE CLAIMS OF SUCH GUARDIAN AND CUSTODIAN CONCURRENTLY ARE BEFORE US.

BY OUR OFFICE LETTERS OF OCTOBER 24, 1966, AND DECEMBER 13, 1966, YOUR ATTORNEY WAS INFORMED THAT THE UNPAID BALANCE DUE THE DECEDENT HAD BEEN CERTIFIED FOR PAYMENT TO NORA B. ADAMSON, FOR THE USE AND BENEFIT OF JERRY JAMES ADAMSON, MINOR SON OF GEORGE G. ADAMSON, DECEASED.

A REVIEW OF OUR RECORDS SHOWS THAT ON MARCH 10, 1966, BOTH LESTER G. ADAMSON AND JERRY JAMES ADAMSON, THE LATTER RESIDING AT BOX 2085, ALHAMBRA, CALIFORNIA, EXECUTED CLAIMS AS SONS OF GEORGE G. ADAMSON, DECEASED, FOR UNPAID COMPENSATION DUE THE DECEDENT. THE CLAIMS DISCLOSED THAT JERRY JAMES ADAMSON WAS A MINOR AND IN CONSONANCE WITH OUR PRACTICE THE AMOUNT DUE HIM WAS WITHHELD PENDING RECEIPT OF A CLAIM ON HIS BEHALF BY HIS GUARDIAN OR LAWFUL CUSTODIAN.

ON MAY 17, 1966, WE RECEIVED A CLAIM FROM NORA B. ADAMSON, BOX 2085, 1428 SOUTH MARENGO AVENUE, ALHAMBRA, CALIFORNIA, CLAIMING FOR THE USE AND BENEFIT OF JERRY JAMES ADAMSON THE UNPAID BALANCE OF $545.54. MRS. ADAMSON'S CLAIM WAS ACCOMPANIED BY A COPY OF A DECREE OF DIVORCE DATED DECEMBER 7, 1964, SHOWING THAT SHE HAD BEEN AWARDED CUSTODY AND CONTROL OF JERRY JAMES ADAMSON.

BY OUR OFFICE SETTLEMENT OF JUNE 21, 1966, THERE WAS CERTIFIED FOR PAYMENT TO NORA B. ADAMSON IN HER FIDUCIARY CAPACITY THE UNPAID BALANCE OF $545.54 FOR THE USE AND BENEFIT OF JERRY JAMES ADAMSON, MINOR. THE SETTLEMENT IS IN ACCORD WITH OUR LONG ESTABLISHED PRACTICE IN DISPOSING OF SMALL AMOUNTS DUE UNDER THE ACT OF AUGUST 3, 1950, 64 STAT. 395, 5 U.S.C. 5582 (FORMERLY 5 U.S.C. 61F.).

YOUR CLAIM AS GUARDIAN OF THE ESTATE OF JERRY J. ADAMSON, WARD, WAS RECEIVED IN OUR OFFICE ON OCTOBER 10, 1966. WHILE NORMALLY PREFERENTIAL RECOGNITION WOULD BE ACCORDED A COURT APPOINTED GUARDIAN OVER A NATURAL GUARDIAN OR CUSTODIAN OF A MINOR WHEN THE CLAIMS OF SUCH GUARDIAN AND CUSTODIAN CONCURRENTLY ARE BEFORE US, WE DO NOT WITHHOLD AN OTHERWISE VALID PAYMENT FROM A PROPER CLAIMANT, ABSENT NOTICE OF AN ADVERSE CLAIM.

SINCE THE UNPAID BALANCE DUE WAS LAWFULLY CERTIFIED FOR PAYMENT TO NORA B. ADAMSON FOR THE USE AND BENEFIT OF YOUR WARD, YOUR CLAIM AS LEGAL GUARDIAN MUST BE DISALLOWED.
