WE DO NOT INTERPRET THAT PROVISION OF LAW AS REQUIRING A DIRECT RENTAL CHARGE TO BE MADE FOR QUARTERS FURNISHED EMPLOYEES WHO ARE ON TEMPORARY DUTY SO AS TO PREVENT YOU FROM FURNISHING QUARTERS TO AN EMPLOYEE ON TEMPORARY DUTY WITHOUT CHARGE AND MAKING AN APPROPRIATE REDUCTION IN HIS PER DIEM IN ACCORDANCE WITH SECTION 6.7 OF THE STANDARDIZED GOVERNMENT TRAVEL REGULATIONS. WHEN PER DIEM IS REDUCED UNDER THAT SECTION ONLY THE NET PER DIEM ALLOWED THE EMPLOYEE IS CHARGED AGAINST APPROPRIATED FUNDS. NO ACCOUNTING FOR MONEY RECEIVED AS A RESULT OF FURNISHING QUARTERS FREE TO EMPLOYEES IN SUCH CIRCUMSTANCES IS REQUIRED. WE SEE NO OBJECTION TO YOUR IMPLEMENTING THE PROPOSED POLICY OF FURNISHING GOVERNMENT QUARTERS WITHOUT CHARGE TO FEDERAL AVIATION AGENCY EMPLOYEES ON TEMPORARY DUTY AND MAKING THE APPROPRIATE REDUCTION IN THE PER DIEM IN LIEU OF SUBSISTENCE OF SUCH EMPLOYEES FOR DAYS ON WHICH QUARTERS ARE FURNISHED.

TO ADMINISTRATOR, FEDERAL AVIATION AGENCY:

WE REFER TO YOUR LETTER OF DECEMBER 16, 1966, CONCERNING THE METHOD OF CHARGING FEDERAL AVIATION AGENCY EMPLOYEES FOR QUARTERS FURNISHED THEM BY THE AGENCY DURING PERIODS OF TEMPORARY DUTY.

5 U.S.C. 5911 REQUIRES THAT EMPLOYEES STATIONED IN THE UNITED STATES BE CHARGED THE REASONABLE VALUE OF GOVERNMENT QUARTERS FURNISHED THEM. HOWEVER, WE DO NOT INTERPRET THAT PROVISION OF LAW AS REQUIRING A DIRECT RENTAL CHARGE TO BE MADE FOR QUARTERS FURNISHED EMPLOYEES WHO ARE ON TEMPORARY DUTY SO AS TO PREVENT YOU FROM FURNISHING QUARTERS TO AN EMPLOYEE ON TEMPORARY DUTY WITHOUT CHARGE AND MAKING AN APPROPRIATE REDUCTION IN HIS PER DIEM IN ACCORDANCE WITH SECTION 6.7 OF THE STANDARDIZED GOVERNMENT TRAVEL REGULATIONS.
