FURTHER REFERENCE IS MADE TO YOUR LETTER OF MARCH 10, 1966, TO THE ADJUTANT GENERAL, DEPARTMENT OF THE ARMY, CONCERNING YOUR CLAIM FOR BACK PAY, LONGEVITY PAY AND WIDOW'S PENSION BELIEVED TO BE DUE IN THE CASE OF YOUR LATE HUSBAND, MASTER SERGEANT WILLIE PENNINGTON, RA 6 362 718, USA, WHO DIED MAY 30, 1951.

BY SETTLEMENT DATED JANUARY 24, 1952, YOU WERE PAID $159.34, THE BALANCE OF PAY DUE YOUR HUSBAND AT THE TIME OF HIS DEATH AND OUR OFFICE HAS ADVISED YOU MANY TIMES SINCE THAT PAYMENT WAS MADE THAT NO FURTHER PAY AND ALLOWANCES IS DUE IN THE CASE. THE "LONGEVITY PAY" WHICH YOU APPEAR TO BELIEVE IS STILL PAYABLE IS NOT A SEPARATE PAYMENT OF PAY DUE YOUR LATE HUSBAND OR YOU. THE TERM "LONGEVITY PAY" HAS REFERENCE TO THE INCREASES, OR RAISES IN PAY WHICH A MEMBER OF THE ARMY RECEIVES BECAUSE OF LENGTH OF SERVICE. AT THE TIME OF HIS DEATH, YOUR HUSBAND HAD OVER 22 YEARS OF SERVICE AND AS A CONSEQUENCE HIS RATE OF PAY HAD INCREASED TO $279.30 PER MONTH. AFTER DEDUCTING HIS ALLOTMENT PAYMENTS AND THE PAYMENTS OF PAY WHICH HE HAD RECEIVED AND ADJUSTING HIS ACCOUNT TO INCLUDE HIS OTHER PAY AND ALLOWANCES, A BALANCE OF $159.34 WAS DUE HIM WHEN HE DIED. THIS BALANCE WAS PAID TO YOU. WE TRUST THIS EXPLANATION WILL HELP YOU TO UNDERSTAND THAT NOTHING FURTHER IS DUE YOU AS MILITARY PAY AND ALLOWANCES BECAUSE OF HIS ARMY SERVICE AND THAT NO FURTHER ACTION MAY BE TAKEN BY THIS OFFICE ON YOUR CLAIM.

AS YOU HAVE BEEN ADVISED, OUR OFFICE HAS NO JURISDICTION OVER CLAIMS FOR WIDOW'S PENSION. SUCH CLAIMS ARE FOR CONSIDERATION BY THE VETERANS ADMINISTRATION. YOUR CLAIM FOR WIDOW'S PENSION SHOULD BE ADDRESSED TO THE REGIONAL OFFICE, VETERANS ADMINISTRATION, MONTGOMERY, ALABAMA.
