WHICH AUTHORIZES A $4 PER DIEM RATE WHEN A TRAVELER ABOARD A GOVERNMENT SHIP IS REQUIRED TO PAY ONLY FOR MEALS. THAT AUTHORITY IS CONSTRUED TO APPLY TO GOVERNMENT SHIPS UPON WHICH MEALS ARE PREPARED AND SERVED TO TRAVELERS. HOWARTH AS ENGINE MAN-DECKHAND WAS WITHOUT GALLEY OR FOOD STORAGE FACILITIES AND THAT NECESSARILY YOU HAD YOUR MEALS AT RESTAURANTS ASHORE OR HAD BUT LIGHT REPASTS ABOARD SUCH AS SANDWICHES AND COFFEE WHICH YOU SUPPLIED AND PREPARED. IT APPEARS THAT DURING YOUR TEMPORARY DUTY TOUR YOU WERE QUARTERED ABOARD YOUR VESSEL. THAT YOUR AUTHORIZED PER DIEM RATE SHOULD HAVE BEEN DETERMINED UNDER SUBPARAGRAPH C 8101-2E OF THE JOINT TRAVEL REGULATIONS WHICH PRESCRIBES A RATE OF $9.

YOUR LETTER OF APRIL 14, 1966, REQUESTS REVIEW OF GENERAL ACCOUNTING OFFICE SETTLEMENT OF APRIL 12, 1966, WHICH DISALLOWED YOUR CLAIM FOR THE DIFFERENCE BETWEEN THE RATES OF PER DIEM OF $4, WHICH YOU WERE ADMINISTRATIVELY ALLOWED, AND THAT OF $9, CLAIMED AS A CIVILIAN EMPLOYEE OF THE ARMY, FORT MILES, LEWES, DELAWARE, FOR TEMPORARY DUTY TRAVEL DURING THE PERIOD OF SEPTEMBER 30 TO OCTOBER 6, 1965.

YOUR CLAIM WAS DISALLOWED UNDER THE PROVISIONS OF THE JOINT TRAVEL REGULATIONS, VOLUME 2, SUBPARAGRAPH C 8101-2D (2), WHICH AUTHORIZES A $4 PER DIEM RATE WHEN A TRAVELER ABOARD A GOVERNMENT SHIP IS REQUIRED TO PAY ONLY FOR MEALS. THAT AUTHORITY IS CONSTRUED TO APPLY TO GOVERNMENT SHIPS UPON WHICH MEALS ARE PREPARED AND SERVED TO TRAVELERS.

WE UNDERSTAND FROM THE RECORD THAT THE PICKET SHIP UPON WHICH YOU SERVED AS MASTER AND MR. HOWARTH AS ENGINE MAN-DECKHAND WAS WITHOUT GALLEY OR FOOD STORAGE FACILITIES AND THAT NECESSARILY YOU HAD YOUR MEALS AT RESTAURANTS ASHORE OR HAD BUT LIGHT REPASTS ABOARD SUCH AS SANDWICHES AND COFFEE WHICH YOU SUPPLIED AND PREPARED. ALSO, IT APPEARS THAT DURING YOUR TEMPORARY DUTY TOUR YOU WERE QUARTERED ABOARD YOUR VESSEL.

WE CONCLUDE, THEREFORE, THAT YOUR AUTHORIZED PER DIEM RATE SHOULD HAVE BEEN DETERMINED UNDER SUBPARAGRAPH C 8101-2E OF THE JOINT TRAVEL REGULATIONS WHICH PRESCRIBES A RATE OF $9, WITH A DEDUCTION OF $1 FOR EACH DAY UPON WHICH GOVERNMENT QUARTERS ARE FURNISHED WITHOUT CHARGE.

THE RECORD FAILS TO REFLECT THAT A DEDUCTION FOR QUARTERS WAS MADE IN YOUR CASE. CONSEQUENTLY, WE ARE TODAY INSTRUCTING OUR CLAIMS DIVISION TO AUTHORIZE SUPPLEMENTAL PER DIEM PAYMENTS TO YOU BASED ON A RATE OF $8, LESS THE $4 RATE PREVIOUSLY ALLOWED.
