HACKING WAS TRANSFERRED TO NEW OFFICIAL HEADQUARTERS IN ESTANCIA. THAT THE ACTION WAS FOR PROMOTION AND TRANSFER IN THE INTEREST OF THE GOVERNMENT AND NOT FOR THE EMPLOYEE'S BENEFIT. IT APPEARS FROM THE INFORMATION YOU HAVE GIVEN US THAT MR. THIS IS CORRECT HIS TRAVEL ORDERS HAVE BEEN COMPILED WITH AND THE VOUCHER MAY BE CERTIFIED FOR PAYMENT. IF HE WAS NOT ACTUALLY ON DUTY AT THE NEW STATION.

TO MR. K. P. BLAIR, STATE ADMINISTRATIVE OFFICER, SOIL CONSERVATION SERVICE:

ON OCTOBER 15, 1965, YOU REQUESTED OUR DECISION WHETHER A TRAVEL VOUCHER FOR MR. VERN J. HACKING, AN EMPLOYEE OF THE SOIL CONSERVATION SERVICE IN RIGBY, IDAHO, MAY BE CERTIFIED FOR PAYMENT.

YOU INFORM US THAT MR. HACKING WAS TRANSFERRED TO NEW OFFICIAL HEADQUARTERS IN ESTANCIA, NEW MEXICO, ON SEPTEMBER 12, 1965, AND THAT THE ACTION WAS FOR PROMOTION AND TRANSFER IN THE INTEREST OF THE GOVERNMENT AND NOT FOR THE EMPLOYEE'S BENEFIT, CONVENIENCE, OR AT HIS REQUEST. ALSO, YOU SAY THAT THE EMPLOYEE INCURRED THE TRAVEL AND MOVING EXPENSES IN GOOD FAITH AND WITH A VIEW OF ESTABLISHING HIMSELF AND FAMILY AT THE NEW OFFICIAL STATION. HOWEVER, UPON ARRIVAL AT AND REPORTING TO THE NEW OFFICIAL STATION THE EMPLOYEE'S WIFE AT ONCE HAD AN ADVERSE REACTION TO THE NEW ENVIRONMENT. AFTER SOME DELIBERATION SHE AND HER HUSBAND PROCEEDED TO THE STATE OFFICE AT ALBUQUERQUE, WHERE MR. HACKING REQUESTED THAT HIS ASSIGNMENT TO NEW MEXICO BE RESCINDED AND HE BE ALLOWED TO RETURN TO HIS FORMER STATION IN IDAHO, EXPLAINING THAT HE HAD NOT FORESEEN THE APPEARANCE OF THE NEW ENVIRONS TO WHICH HE HAD BEEN TRANSFERRED, OR WHAT HIS WIFE'S REACTION WOULD BE UPON ARRIVAL THEREAT, AND THAT IN THE INTEREST OF HIS WIFE'S HEALTH HE SHOULD RETURN TO IDAHO. AS A RESULT MR. HACKING ONLY REMAINED AT HIS NEW OFFICIAL STATION FOR TWO AND ONE-HALF DAYS, HAVING ARRIVED ON FRIDAY, SEPTEMBER 10, 1965.

THE EMPLOYEE HAS PAID HIS OWN AND HIS FAMILY'S EXPENSES OUT OF HIS OWN FUNDS ON THE RETURN TRIP TO IDAHO. HE HAS SUBMITTED HIS TRAVEL VOUCHER COVERING THE MOVE FROM RIGBY, IDAHO, TO ESTANCIA, NEW MEXICO.

IT APPEARS FROM THE INFORMATION YOU HAVE GIVEN US THAT MR. HACKING ACTUALLY ENTERED ON DUTY AT HIS NEW STATION ON FRIDAY, SEPTEMBER 10. THIS IS CORRECT HIS TRAVEL ORDERS HAVE BEEN COMPILED WITH AND THE VOUCHER MAY BE CERTIFIED FOR PAYMENT, IF OTHERWISE CORRECT. HOWEVER, IF HE WAS NOT ACTUALLY ON DUTY AT THE NEW STATION, HE MAY NOT BE REGARDED AS HAVING PERFORMED TRAVEL IN THE INTEREST OF THE GOVERNMENT, AND THE VOUCHER MAY NOT BE CERTIFIED FOR PAYMENT.
