TO THE HONORABLE, THE SECRETARY OF THE ARMY:

REFERENCE IS MADE TO LETTER DATED APRIL 26, 1965, FROM THE DEPUTY ASSISTANT SECRETARY OF THE ARMY (I AND L), LOGISTICS, CONCERNING THE APPLICATION OF THE PORT OF HOUSTON IRON WORKS FOR REMISSION ON AN EQUITABLE BASIS OF LIQUIDATED DAMAGES ASSESSED UNDER NEGOTIATED CONTRACT NO. DA-41-243-ENG-2873, DATED FEBRUARY 3, 1955, AT A FIXED PRICE OF $54,000 FOR REMOVAL OF A SUNKEN VESSEL OBSTRUCTING NAVIGATION AT BRAZOS SANTIAGO PASS ON THE GULF INTRACOASTAL WATERWAY, NEAR BROWNSVILLE, TEXAS.

BY VIRTUE OF THE AUTHORITY VESTED IN ME BY THE PROVISIONS OF SECTION 2312, 10 UNITED STATES CODE, I HEREBY APPROVE REMISSION OF THE LIQUIDATED DAMAGES ASSESSED UNDER THE ABOVE-MENTIONED CONTRACT IN THE AMOUNT OF $14,685.09, IN ACCORDANCE WITH THE RECOMMENDATION OF THE DEPUTY ASSISTANT SECRETARY.
