SECRETARY: REFERENCE IS MADE TO LETTER OF NOVEMBER 10. THESE SERVICES ARE DESCRIBED AS FOLLOWS: FREQUENCY SIZE SERVICES FOR POINTS SERVICED OF FLIGHTS AIRCRAFT ALASKAN AIR ELMENDORF AFB AND AS ORDERED DC-3. SMALL AIRCRAFT CALIFORNIA SUBSTITUTION OF A SIMILAR CERTIFICATE FOR THE MAC FORM 8 WAS PREVIOUSLY APPROVED. IN TWO SITUATIONS IN WHICH SERVICES WERE TO BE FURNISHED UNDER MAC FIXED-PRICE CONTRACTS BETWEEN POINTS WHERE NO MAC TRAFFIC PERSONNEL WERE STATIONED. ALTHOUGH THE INSTANT REQUEST IS SILENT ON THE MATTER. IT APPEARS THAT THE SERVICING POINTS CITED THEREIN LIKEWISE DO NOT HAVE THE MAC TRAFFIC PERSONNEL NECESSARY TO ACCOMPLISH MAC FORMS 8 OR OTHER APPROVED DOCUMENTS TO SUPPORT THE CONTRACTORS' BILLINGS.

REFERENCE IS MADE TO LETTER OF NOVEMBER 10, 1969, ADDRESSED TO OUR TRANSPORTATION DIVISION BY COLONEL G. E. NEUBURG, DIRECTOR OF PROCUREMENT, DCS/MATERIEL, HEADQUARTERS, MILITARY AIRLIFT COMMAND (MAC), REQUESTING AUTHORITY TO SUBSTITUTE A "CERTIFICATE OF SERVICES PERFORMED AND ACCEPTED" FOR THE MAC FORM 8, CIVIL AIRCRAFT CERTIFICATE, IN CONNECTION WITH CERTAIN SERVICES TO BE FURNISHED UNDER CONTRACT TO FILL A SMALL AIRLIFT REQUIREMENT FOR THE NAVAL SUPPLY SYSTEMS COMMAND. THESE SERVICES COVER FLIGHTS BETWEEN THE ATLANTIC UNDERSEA TEST AND EVALUATION CENTER, PALM BEACH, FLORIDA, AND VARIOUS POINTS IN THE BAHAMAS AND IN FLORIDA, USING A 40-PASSENGER AIRCRAFT.

THE MILITARY AIRLIFT COMMAND ALSO REQUESTS BLANKET APPROVAL FOR THE USE OF THE CERTIFICATE ON ALL MAC FIXED-PRICE CONTRACTS AWARDED DURING THE REMAINDER OF FISCAL YEAR 1970 AND DURING ENSUING FISCAL YEARS FOR CERTAIN OTHER DOMESTIC AIRLIFT SERVICES NOT COVERED BY THE MAC FORM 8; THE UNITED STATES OF AMERICA TRANSPORTATION REQUEST, STANDARD FORM 1169; OR THE CERTIFICATE OF SERVICES PERFORMED AND ACCEPTED. IN VIEW OF THE NATURE OF THIS TRAFFIC AND THE ABSENCE OF DIFFICULTIES ENCOUNTERED IN OUR AUDIT OF BILLINGS SUPPORTED WITH SIMILAR CERTIFICATES, WE WILL INTERPOSE NO OBJECTION TO THE REQUESTED SUBSTITUTION OF A CERTIFICATE OF SERVICES PERFORMED AND ACCEPTED FOR THE MAC FORM 8. THIS APPROVAL, HOWEVER, IS SUBJECT TO THE FOLLOWING CONDITIONS AND REQUIREMENTS.

1. THIS AUTHORITY IS APPLICABLE ONLY TO THE FIXED-PRICE-TYPE CONTRACT AIRLIFT SERVICES HEREINABOVE CITED.

2. THE CERTIFICATE OF SERVICES PERFORMED AND ACCEPTED WILL SUBSTANTIALLY FOLLOW THE FORMAT SHOWN BELOW.

3.THE CONTRACTOR WILL SUBMIT ITS BILLINGS ON PUBLIC VOUCHER FOR TRANSPORTATION CHARGES, STANDARD FORM 1113, FOR FREIGHT OR ON PUBLIC VOUCHER FOR TRANSPORTATION OF PASSENGERS, STANDARD FORM 1171, FOR PASSENGER, SUPPORTED BY A PROPERLY DOCUMENTED CERTIFICATE OF SERVICES PERFORMED AND ACCEPTED.

4. THE CONTRACTOR WILL SHOW ON THE SF 1113 OR 1171, AS APPLICABLE, THE FOLLOWING INFORMATION IN ADDITION TO ANY SPECIFIC INFORMATION REQUIRED BY THE CONTROLLING CONTRACT.

A. CONTRACT NUMBER AND DATE.

B. PERIOD COVERED BY THE FLIGHTS.

C. TOTAL CHARGE.

5. THE CONTRACTOR WILL BILL NO MORE THAN 1 MONTH'S FLIGHTS ON THE SF 1113 OR 1171.

THE AUTHORITY GRANTED HEREIN FOR USE OF THE CERTIFICATE OF SERVICES PERFORMED AND ACCEPTED IS SUBJECT TO THE FURTHER CONDITION THAT A SPECIAL EXEMPTION WILL BE OBTAINED FROM THE SECRETARY OF THE TREASURY IN THE EVENT ANY OF THE TRANSPORTATION PAYMENTS FOR SERVICES COVERED BY THE CERTIFICATE ARE OTHERWISE SUBJECT TO THE TAX IMPOSED UNDER SECTIONS 4261, 4262, AND 4291 OF THE INTERNAL REVENUE CODE OF 1954, AS AMENDED, 26 U.S.C. 4261, 4262, AND 4291. ALSO, THE MILITARY AIRLIFT COMMAND SHALL ENSURE THAT AIR CARRIERS HAVE SECURED FROM THE CIVIL AERONAUTICS BOARD SUCH EXEMPTIONS FROM TARIFF FILING REQUIREMENTS AS MAY BE NECESSARY FOR THE AIRCRAFT AND SERVICES INVOLVED.

IN ADDITION TO THE ABOVE CONDITIONS AND REQUIREMENTS, ADMINISTRATIVE RECORDS FOR THE INVOLVED PAYMENTS SHALL BE RETAINED FOR SUCH PERIOD AS IS APPLICABLE TO OTHER DOMESTIC AND INTERNATIONAL AIR TRAFFIC.
