WE HAVE DETERMINED THAT MISS GWINN IS ENTITLED TO BE PAID THE OVERTIME COMPENSATION SHE CLAIMS FOR THE PERIOD JULY 25. IS BARRED BY THE ACT OF OCTOBER 9. SINCE SUCH CLAIM WAS NOT RECEIVED IN OUR OFFICE UNTIL JULY 25. WE HAVE TODAY INSTRUCTED OUR CLAIMS DIVISION TO ISSUE SETTLEMENT TO HER FOR THE AMOUNT FOUND DUE.

WE REFER TO THE CLAIM OF MISS MARGARET GWINN FOR OVERTIME COMPENSATION AS AN EMPLOYEE OF THE DEPARTMENT OF JUSTICE, FEDERAL REFORMATORY FOR WOMEN, ALDERSON, WEST VIRGINIA, WHICH YOU PRESENTED TO OUR OFFICE AS MISS GWINN'S REPRESENTATIVE BY LETTER DATED JULY 24, 1963, YOUR REFERENCE 4C/L-1494.

IN VIEW OF THE EVIDENCE WHICH WAS PRESENTED WITH YOUR ORIGINAL LETTER AND WITH YOUR LETTER OF AUGUST 12, 1964, WE HAVE DETERMINED THAT MISS GWINN IS ENTITLED TO BE PAID THE OVERTIME COMPENSATION SHE CLAIMS FOR THE PERIOD JULY 25, 1953, TO SEPTEMBER 26, 1958, ON THE BASIS OF 30 MINUTES FOR EACH DAY ON WHICH SHE ACTUALLY PERFORMED OVERTIME SERVICES. THAT PART OF HER CLAIM WHICH ACCRUED BEFORE JULY 25, 1953, IS BARRED BY THE ACT OF OCTOBER 9, 1940, CH. 788, 54 STAT. 1061, 31 U.S.C. 71A, SINCE SUCH CLAIM WAS NOT RECEIVED IN OUR OFFICE UNTIL JULY 25, 1963.

WE HAVE TODAY INSTRUCTED OUR CLAIMS DIVISION TO ISSUE SETTLEMENT TO HER FOR THE AMOUNT FOUND DUE. THE ACTION OF THAT DIVISION IN THIS MATTER SHOULD BE COMPLETED IN THE NEAR FUTURE.
