FURTHER REFERENCE IS MADE TO LETTER DATED JULY 27, 1964, WITH ENCLOSURES, FROM COUNSEL, HEADQUARTERS, DEFENSE SUPPLY AGENCY, CAMERON STATION, ALEXANDRIA, VIRGINIA, RECOMMENDING REMISSION, UNDER 41 U.S.C. 256A, ON AN EQUITABLE BASIS OF STORAGE CHARGES IN THE SUM OF $8,677.91, ASSESSED AGAINST THE M. BERGER COMPANY IN THE AMOUNT OF $11,065.36 BY REASON OF ITS FAILURE TO TIMELY REMOVE CERTAIN PROPERTY WHICH IT PURCHASED UNDER GOVERNMENT SURPLUS SPOT BID SALES NOS. 30-127 S-60-15, 30-127-S-60-17 AND 30-127-S-60-19.

BY VIRTUE OF THE AUTHORITY VESTED IN ME UNDER 41 U.S.C. 256A I HEREBY APPROVE REMISSION OF THE STORAGE CHARGES ASSESSED UNDER THE ABOVE- IDENTIFIED SALES TRANSACTIONS IN THE AMOUNT OF $8,677.91 PROVIDED THAT PRIOR TO SUCH REMISSION PAYMENT BE MADE BY THE COMPANY TO THE DEFENSE SUPPLY AGENCY IN THE SUM OF $2,387.45, WHICH REPRESENTS THAT PORTION OF THE TOTAL ASSESSMENT OF STORAGE CHARGES FOR WHICH THERE WAS FOUND NO EQUITABLE BASIS FOR REMISSION.
