INCORPORATED: FURTHER REFERENCE IS MADE TO YOUR TELEGRAM DATED MAY 18. THE BIDS WERE OPENED MAY 15. SINCE THERE WAS NO AVAILABLE INFORMATION CONCERNING THE RESPONSIBILITY OF THE TWO LOW BIDDERS. WAS REQUESTED TO CONDUCT PREAWARD SURVEYS ON BOTH FIRMS. THE CONTRACTING OFFICER DETERMINED THAT NEITHER MANPOWER NOR YOUR COMPANY IS A RESPONSIBLE PROSPECTIVE CONTRACTOR AS TO CAPACITY AND CREDIT. FURTHER REFERENCE IS MADE TO YOUR TELEGRAM DATED MAY 18, 1964, PROTESTING AWARD TO MANPOWER, INCORPORATED, OF MONTGOMERY, ALABAMA, UNDER DEPARTMENT OF THE NAVY INVITATION NO. IFB-204-60-64, ISSUED BY THE UNITED STATES NAVAL AIR STATION, PENSACOLA, FLORIDA, FOR CUSTODIAL SERVICES, SET ASIDE FOR SMALL BUSINESS.

THE BIDS WERE OPENED MAY 15, 1964, THE LOW BID BEING SUBMITTED BY MANPOWER, AND THE SECOND LOW BID BY YOUR COMPANY.

SINCE THERE WAS NO AVAILABLE INFORMATION CONCERNING THE RESPONSIBILITY OF THE TWO LOW BIDDERS, THE INSPECTOR OF NAVAL MATERIAL, ATLANTA, GEORGIA, WAS REQUESTED TO CONDUCT PREAWARD SURVEYS ON BOTH FIRMS. BASED ON SUCH SURVEYS, THE CONTRACTING OFFICER DETERMINED THAT NEITHER MANPOWER NOR YOUR COMPANY IS A RESPONSIBLE PROSPECTIVE CONTRACTOR AS TO CAPACITY AND CREDIT. INASMUCH AS BOTH FIRMS HAD STATED THAT THEY WERE SMALL BUSINESS CONCERNS, THE SMALL BUSINESS ADMINISTRATION, ATLANTA, GEORGIA, WAS NOTIFIED JUNE 5, 1964, OF THE CONTRACTING OFFICER'S DETERMINATION TO REJECT THESE BIDS IN ORDER TO PERMIT THE SMALL BUSINESS ADMINISTRATION TO CONSIDER WHETHER IT WOULD ISSUE CERTIFICATES OF COMPETENCY IN ACCORDANCE WITH ARMED SERVICES PROCUREMENT REGULATION (ASPR) 1-705.6.

BY TELEGRAM DATED JUNE 12, 1964, THE CONTRACTING OFFICER WAS NOTIFIED BY THE SMALL BUSINESS ADMINISTRATION, ATLANTA, GEORGIA, THAT MANPOWER, INCORPORATED, HAD DECLINED TO APPLY FOR A CERTIFICATE OF COMPETENCY, AND BY LETTER DATED JUNE 18, 1964, THE CONTRACTING OFFICER WAS NOTIFIED THAT YOUR COMPANY HAD WITHDRAWN ITS REQUEST FOR CERTIFICATE OF COMPETENCY IN CONNECTION WITH IFB-204-60-64, THAT THE CASE WAS CLOSED AND THAT THERE WOULD BE NO FURTHER ACTION BY THE SMALL BUSINESS ADMINISTRATION. ACCORDINGLY, AWARD WAS MADE ON JUNE 19, 1964, TO MAGNUS CORPORATION, THE NEXT LOWEST RESPONSIBLE BIDDER.

IN VIEW OF THE FOREGOING AND SINCE THE ADMINISTRATIVE ACTION APPEARS TO HAVE BEEN IN ACCORDANCE WITH APPLICABLE REGULATIONS, THE CASE WILL BE CONSIDERED AS CLOSED BY THIS OFFICE.
