ELECTIONS TO RECEIVE A REDUCED AMOUNT OF RETIRED PAY TO PROVIDE AN ANNUITY FOR A SPOUSE AND/OR CHILDREN ARE MADE ON DA FORM 1041. THE ORIGINAL IS SIGNED BY THE SERVICE MEMBER AND THE WITNESS. THE ORIGINAL IS MAINTAINED IN THE FILES OF THE ADJUTANT GENERAL'S OFFICE UNTIL SUCH TIME AS THE MEMBER IS RETIRED. AT WHICH TIME IT IS FORWARDED TO THE FINANCE CENTER. THE COPIES ARE DISTRIBUTED AS FOLLOWS: ONE IS RETURNED TO THE MEMBER FOR HIS PERSONAL FILE. ONE IS MAINTAINED IN THE ADJUTANT GENERAL'S ALTERNATE FILE. ONE IS PLACED IN THE MEMBER'S 201 FILE AT HIS MILITARY POST WHICH AFTER SEPARATION IS KEPT AT ST. IT IS STATED THAT IN ORDER TO FACILITATE THE MAINTENANCE OF THE ALTERNATE FILES THE ADJUTANT GENERAL HAS PROPOSED THAT PUNCH CARDS BE PREPARED WHICH WILL REFLECT THE REQUESTED OPTION OF THE SERVICE MEMBER TOGETHER WITH APPROPRIATE IDENTIFYING INFORMATION.

REFERENCE IS MADE TO YOUR LETTER OF APRIL 8, 1964, REQUESTING A DECISION CONCERNING DOCUMENTS TO BE USED IN THE ALTERNATE FILES OF THE ADJUTANT GENERAL'S OFFICE IN CONNECTION WITH THE RETIRED SERVICEMAN'S FAMILY PROTECTION PLAN.

ELECTIONS TO RECEIVE A REDUCED AMOUNT OF RETIRED PAY TO PROVIDE AN ANNUITY FOR A SPOUSE AND/OR CHILDREN ARE MADE ON DA FORM 1041. THE ORIGINAL IS SIGNED BY THE SERVICE MEMBER AND THE WITNESS, WITH THEIR SIGNATURES REPRODUCED ON COPIES BY CARBON PAPER. THE ORIGINAL IS MAINTAINED IN THE FILES OF THE ADJUTANT GENERAL'S OFFICE UNTIL SUCH TIME AS THE MEMBER IS RETIRED, AT WHICH TIME IT IS FORWARDED TO THE FINANCE CENTER, U.S. ARMY, AS A SUPPORTING DOCUMENT FOR THE DEDUCTION OF THE COST OF THE ANNUITY FROM THE MEMBER'S RETIRED PAY AND THE SUBSEQUENT PAYMENT OF THE ANNUITY. THE COPIES ARE DISTRIBUTED AS FOLLOWS: ONE IS RETURNED TO THE MEMBER FOR HIS PERSONAL FILE, ONE IS MAINTAINED IN THE ADJUTANT GENERAL'S ALTERNATE FILE, AND ONE IS PLACED IN THE MEMBER'S 201 FILE AT HIS MILITARY POST WHICH AFTER SEPARATION IS KEPT AT ST. LOUIS, MISSOURI.

IT IS STATED THAT IN ORDER TO FACILITATE THE MAINTENANCE OF THE ALTERNATE FILES THE ADJUTANT GENERAL HAS PROPOSED THAT PUNCH CARDS BE PREPARED WHICH WILL REFLECT THE REQUESTED OPTION OF THE SERVICE MEMBER TOGETHER WITH APPROPRIATE IDENTIFYING INFORMATION. IT IS UNDERSTOOD THAT THE PUNCH CARD WOULD BE SUBSTITUTED FOR THE FORM 1041 IN THE ALTERNATE FILE AND WOULD BE USED TO SUPPORT DEDUCTION OF THE ANNUITY COST FROM THE MEMBER'S RETIRED PAY AND THE SUBSEQUENT PAYMENT OF THE ANNUITY IF THE ORIGINAL DA FORM 1041 CANNOT BE LOCATED.

THE QUESTION ON WHICH A DECISION IS REQUESTED IS STATED AS FOLLOWS:

"A DECISION IS REQUESTED AS TO WHETHER A PUNCH CARD MAY BE USED AS PROPOSED. IN THE EVENT OF AN AFFIRMATIVE ANSWER, SHOULD THE FORM CONTAIN A CERTIFICATION OF ACCURACY BY EITHER THE USE OF THE OFFICIAL SEAL OF THE ADJUTANT GENERAL, OR BY SIGNATURE OF A DULY AUTHORIZED REPRESENTATIVE OF THE ADJUTANT GENERAL?

THE QUESTION PRESENTED IS ANSWERED IN THE AFFIRMATIVE. IT IS UNDERSTOOD THAT PUNCH CARDS HAVE ALREADY BEEN PREPARED IN THE CASES OF ALL ELECTIONS THAT HAVE HERETOFORE BEEN MADE AND THAT IT WOULD BE VERY COSTLY TO PREPARE NEW CARDS OR TO VERIFY THE EXISTING CARDS IN ALL SUCH CASES. IN VIEW THEREOF, IF SUCH PUNCH CARDS WERE DULY VERIFIED AS TO THAT THEY HAVE), A SEPARATE BLANKET STATEMENT SIGNED BY A DULY AUTHORIZED REPRESENTATIVE OF THE ADJUTANT GENERAL SO CERTIFYING WILL BE ACCEPTABLE TO THIS OFFICE AS SUFFICIENT VERIFICATION IN ANY CASE WHERE NO COPY OF THE ELECTION CAN BE FOUND. ALL FUTURE PUNCH CARDS SHOULD BE CERTIFIED FOR ACCURACY BY THE USE OF THE OFFICIAL SEAL OF THE ADJUTANT GENERAL OR BY A SIGNATURE OF A DULY AUTHORIZED REPRESENTATIVE OF THE ADJUTANT GENERAL.
