FORTAS AND PORTER: FURTHER REFERENCE IS MADE TO YOUR LETTER OF APRIL 2. AS YOU WERE ADVISED IN LETTER DATED APRIL 21. THE PROCEDURE ADOPTED UNDER THE INVITATION FOR BIDS REFERRED TO ABOVE WAS AN ATTEMPT TO OBTAIN LOWER PRICES FOR THE SUPPLIES AND SERVICES INVOLVED BY DEVELOPING DIRECT PRICE COMPETITION. BIDS RECEIVED IN RESPONSE TO THE INVITATION WERE OPENED ON APRIL 6. IT WAS FOUND THAT THE PRICES QUOTED WERE APPROXIMATELY THE SAME AS UNDER THE MORE FLEXIBLE MULTI-AWARD SYSTEM PRESENTLY IN USE. IT WAS THEREFORE DECIDED THAT NO AWARD SHOULD BE MADE UNDER THE INVITATION AND ALL BIDS WERE REJECTED.

FURTHER REFERENCE IS MADE TO YOUR LETTER OF APRIL 2, 1964, FORWARDING A COPY OF A LETTER OF THE SAME DATE TO THE ADMINISTRATOR, GENERAL SERVICES ADMINISTRATION, PROTESTING ON BEHALF OF MID-CONTINENT INDEPENDENT REFINERS ASSOCIATION, THE PROCEDURES IN CONTRACTING FOR SERVICE STATION DELIVERIES OF GASOLINE AND RELATED PRODUCTS AND SERVICES FOR GOVERNMENT VEHICLES UNDER INVITATION FOR BIDS NO. FPNGF/1/-B-27225-A-4-6-64.

AS YOU WERE ADVISED IN LETTER DATED APRIL 21, 1964, FROM THE COMMISSIONER, FEDERAL SUPPLY SERVICE, GENERAL SERVICES ADMINISTRATION, THE PROCEDURE ADOPTED UNDER THE INVITATION FOR BIDS REFERRED TO ABOVE WAS AN ATTEMPT TO OBTAIN LOWER PRICES FOR THE SUPPLIES AND SERVICES INVOLVED BY DEVELOPING DIRECT PRICE COMPETITION. IN VIEW OF THE ACTION TAKEN BY THE GENERAL SERVICES ADMINISTRATION IN REJECTING ALL BIDS AND CANCELLING THE INVITATION FOR BIDS INVOLVED NO FURTHER ACTION BY THIS OFFICE APPEARS NECESSARY IN THE MATTER.
