IT IS REPORTED BY THE AGENCY THAT YOU WERE HIRED ON A "STATESIDE RECRUIT" ACTION AND THAT YOUR PAPERS WERE PROCESSED THROUGH THE U.S. APPARENTLY YOU WERE RESIDING IN ROCHESTER. INOCULATIONS WERE REQUIRED INCIDENT TO THE TRAVEL TO BE PERFORMED. SOME TWO MONTHS PRIOR TO YOUR DEPARTURE FOR YOUR DUTY STATION YOU WERE ADVISED BY COMMUNICATION FROM THE BUFFALO OFFICE THAT YOUR SATISFACTORY MEDICAL REPORT HAD BEEN RECEIVED. YOU WERE FURNISHED A STANDARD FORM NO. 601. ALTHOUGH THE SERVICE WAS AVAILABLE AT THE U.S. PUBLIC HEALTH SERVICE IN ROCHESTER YOU OBTAINED THE INOCULATIONS FROM PRIVATE PHYSICIANS AND FILED CLAIM FOR REIMBURSEMENT OF THE COST THEREOF WHICH CLAIM WAS DISALLOWED. IN SUPPORT OF YOUR REQUEST FOR FURTHER CONSIDERATION OF YOUR CLAIM YOU ASSERT THAT THE CHARGES WERE REASONABLE AND THAT YOU WERE NOT ADVISED THAT REASONABLE CHARGES WOULD BE DISALLOWED.

ON MARCH 2, 1964, YOU REQUESTED REVIEW OF GENERAL ACCOUNTING OFFICE SETTLEMENT OF FEBRUARY 13, 1964, WHICH DISALLOWED YOUR CLAIM FOR COSTS OF INOCULATIONS INCIDENT TO YOUR EMPLOYMENT WITH THE DEPARTMENT OF THE ARMY.

IT IS REPORTED BY THE AGENCY THAT YOU WERE HIRED ON A "STATESIDE RECRUIT" ACTION AND THAT YOUR PAPERS WERE PROCESSED THROUGH THE U.S. ARMY ENGINEER DISTRICT, BUFFALO, NEW YORK. APPARENTLY YOU WERE RESIDING IN ROCHESTER, NEW YORK. INOCULATIONS WERE REQUIRED INCIDENT TO THE TRAVEL TO BE PERFORMED.

SOME TWO MONTHS PRIOR TO YOUR DEPARTURE FOR YOUR DUTY STATION YOU WERE ADVISED BY COMMUNICATION FROM THE BUFFALO OFFICE THAT YOUR SATISFACTORY MEDICAL REPORT HAD BEEN RECEIVED. WITH THAT COMMUNICATION, ADDRESSED TO YOU AT 1479 CREEK STREET, ROCHESTER, NEW YORK, YOU WERE FURNISHED A STANDARD FORM NO. 601, IMMUNIZATION RECORD, WITH A LIST OF THE REQUIRED INOCULATIONS AND INFORMED THAT IF YOU COULD OBTAIN THEM AT THE U.S. PUBLIC HEALTH SERVICE ALSO IN ROCHESTER THERE WOULD BE NO CHARGE. OTHERWISE YOU COULD OBTAIN THEM FROM YOUR PRIVATE PHYSICIAN AND OBTAIN REIMBURSEMENT.

ALTHOUGH THE SERVICE WAS AVAILABLE AT THE U.S. PUBLIC HEALTH SERVICE IN ROCHESTER YOU OBTAINED THE INOCULATIONS FROM PRIVATE PHYSICIANS AND FILED CLAIM FOR REIMBURSEMENT OF THE COST THEREOF WHICH CLAIM WAS DISALLOWED.

IN SUPPORT OF YOUR REQUEST FOR FURTHER CONSIDERATION OF YOUR CLAIM YOU ASSERT THAT THE CHARGES WERE REASONABLE AND THAT YOU WERE NOT ADVISED THAT REASONABLE CHARGES WOULD BE DISALLOWED. YOU ALSO POINT OUT A STATEMENT IN ARMY PAMPHLET NO. 690-1, WHICH HAD BEEN FURNISHED YOU, TO THE EFFECT THAT THE EXPENSE IS REIMBURSABLE IF IT IS NECESSARY TO USE PRIVATE MEDICAL FACILITIES AND FINALLY, THAT YOU HAD NO POSITIVE ASSURANCE OF A POSITION WITH THE AGENCY PRIOR TO COMPLETION OF THE INOCULATIONS AND THE SIGNING OF THE TRAVEL AGREEMENT AND THEREFORE YOU COULD NOT JEOPARDIZE YOUR EXISTING EMPLOYMENT BY TAKING TIME OFF.

SECTION 10.4D OF THE STANDARDIZED GOVERNMENT TRAVEL REGULATIONS AS WELL AS THE ARMY CIVILIAN PERSONNEL REGULATIONS, T3.7-7H (8), PROVIDE FOR REIMBURSEMENT FOR REASONABLE CHARGES FOR INOCULATIONS WHICH CANNOT BE OBTAINED THROUGH A FEDERAL DISPENSARY. YOU SAY THAT THE ARMY PAMPHLET CONTAINED A PROVISION FOR REIMBURSEMENT IF IT WAS NECESSARY FOR YOU TO USE PRIVATE MEDICAL FACILITIES. ALSO, YOU WERE SPECIFICALLY ADVISED TO OBTAIN THE INOCULATIONS FROM YOUR PRIVATE PHYSICIAN IF YOU COULD NOT GET THEM AT THE PUBLIC HEALTH SERVICE IN ROCHESTER.

IN VIEW OF THE REGULATIONS AND OF THE SPECIFIC ADVICE WHICH YOU WERE GIVEN THE AGENCY HAD NO REASON TO ASSUME THAT YOU WOULD USE PRIVATE MEDICAL FACILITIES AND FILE CLAIM FOR THE RESULTING COSTS DESPITE THE AVAILABILITY OF THE SERVICE AT A GOVERNMENT DISPENSARY AT NO CHARGE TO YOU. THEREFORE, THERE APPEARED NO REASON TO ADVISE YOU THAT SUCH CLAIM WOULD BE DISALLOWED.

REGARDING YOUR STATEMENT THAT YOU HAD NO POSITIVE ASSURANCE OF A POSITION WITH THE AGENCY, TC., WE POINT OUT THAT YOU HAD BEEN ADVISED THAT YOUR MEDICAL REPORT WAS SATISFACTORY. ALSO, YOU HAD BEEN FURNISHED A LIST OF REQUIRED INOCULATIONS AND ADVISED THAT THEY MIGHT BE OBTAINED WITHOUT CHARGE AT THE NAMED GOVERNMENT DISPENSARY IN ROCHESTER. THE REGULATIONS MAKE NO PROVISION FOR REIMBURSEMENT UNDER SUCH CIRCUMSTANCES, AND THEREFORE, A PERSON WHO OBTAINS THE SERVICE FROM PRIVATE PHYSICIANS BECAUSE IT IS MORE CONVENIENT OR FOR OTHER PERSONAL REASONS MUST BEAR THE COSTS THEREOF.
