WERE AMENDED TO INCLUDE A STATEMENT THAT YOU HAD OVER 4 YEARS' SERVICE AND THAT DISLOCATION ALLOWANCE AND TRAVEL OF DEPENDENTS TO A DESIGNATED POINT WAS AUTHORIZED. YOUR CLAIM WAS ALLOWED ON A MILEAGE BASIS FROM OFFUTT AIR FORCE BASE. FOR THE REASON THAT EVIDENCE OF APPROVAL BY THE OVERSEAS COMMANDER PRIOR TO THE TIME OF THE TRAVEL OF THE DEPENDENTS AS REQUIRED BY PARAGRAPH 7008 (B) OF THE JOINT TRAVEL REGULATIONS WAS NOT FURNISHED. REFERENCE IS MADE TO YOUR LETTER OF DECEMBER 17, 1963, REQUESTING RECONSIDERATION OF OUR ACTION DATED JULY 31, 1963, WHICH ALLOWED THE SUM OF $84.36, IN CONNECTION WITH YOUR CLAIM FOR $528.65 BELIEVED DUE YOU AS REIMBURSEMENT FOR YOUR DEPENDENTS' TRAVEL FROM OMAHA, NEBRASKA, TO ADANA, TURKEY, NOVEMBER 13 TO 14, 1962.

BY ORDERS DATED MAY 1, 1962, YOU WERE TRANSFERRED ON PERMANENT CHANGE OF STATION FROM OFFUTT AIR FORCE BASE, NEBRASKA, TO TUSLOG DETACHMENT 10, USAFE, APO 289, NEW YORK, NEW YORK (ADANA, TURKEY). THE ORDERS DIRECTED YOU TO REPORT TO MATS PASSENGER SERVICE COUNTER, MCGUIRE AIR FORCE BASE, NEW JERSEY, ON JUNE 21, 1962, FOR SCHEDULED DEPARTURE TO YOUR OVERSEAS DESTINATION. BY ORDERS DATED JANUARY 29, 1963, THE ORDERS OF MAY 1, 1962, WERE AMENDED TO INCLUDE A STATEMENT THAT YOU HAD OVER 4 YEARS' SERVICE AND THAT DISLOCATION ALLOWANCE AND TRAVEL OF DEPENDENTS TO A DESIGNATED POINT WAS AUTHORIZED. YOUR DEPENDENTS TRAVELED FROM OMAHA, NEBRASKA, TO ADANA, TURKEY, NOVEMBER 13 TO 14, 1962, BY PAN AMERICAN AIRLINES.

BY SETTLEMENT DATED JULY 31, 1963, YOUR CLAIM WAS ALLOWED ON A MILEAGE BASIS FROM OFFUTT AIR FORCE BASE, NEBRASKA, TO NEW YORK, NEW YORK, ONLY, FOR THE REASON THAT EVIDENCE OF APPROVAL BY THE OVERSEAS COMMANDER PRIOR TO THE TIME OF THE TRAVEL OF THE DEPENDENTS AS REQUIRED BY PARAGRAPH 7008 (B) OF THE JOINT TRAVEL REGULATIONS WAS NOT FURNISHED, AND THE AMENDED ORDERS OF JANUARY 29, 1963, RESTRICTED YOUR DEPENDENTS' TRAVEL TO A DESIGNATED POINT.

YOU HAVE NOW FURNISHED EVIDENCE TO SHOW THAT ON OCTOBER 18, 1962, YOU HAD APPLIED FOR THE TRANSPORTATION OF YOUR DEPENDENTS TO YOUR OVERSEAS STATION AND, ALTHOUGH THE ORIGINAL REQUEST HAD BEEN LOST, YOUR COMMANDING OFFICE HAD SIGNED THE COPY ON OCTOBER 7, 1963, INDICATING HIS APPROVAL BECAUSE HE RECALLED HE HAD SEEN AND HAD APPROVED THE ORIGINAL APPLICATION. YOU THEREFORE REQUEST ACTION ON YOUR CLAIM FOR THE BALANCE OF THE $528.65 BELIEVED TO BE DUE.

PARAGRAPH 7008-2B OF THE JOINT TRAVEL REGULATIONS, PROMULGATED PURSUANT TO THE PERTINENT STATUTE, 37 U.S.C. 406, AND IN EFFECT AT THE TIME UNDER CONSIDERATION, PROVIDES IN EFFECT THAT WHEN DEPENDENTS ARE AUTHORIZED TO TRAVEL AT THE SAME TIME THE MEMBER TRAVELS TO HIS NEW OVERSEAS PERMANENT STATION, BUT THE MEMBER DOES NOT ELECT TO MOVE HIS DEPENDENTS AT SUCH TIME, THE DEPENDENTS MAY BE MOVED AT GOVERNMENT EXPENSE TO THE OVERSEAS STATION AT A LATER DATE, UPON APPROVAL OF THE OVERSEAS COMMANDER OR OTHER COMPETENT AUTHORITY. ALTHOUGH THE ORDERS OF JANUARY 29, 1963, DID NOT PROPERLY INDICATE THAT TRANSPORTATION OF YOUR DEPENDENTS TO YOUR OVERSEAS STATION WAS AUTHORIZED, IT APPEARS THAT AUTHORIZATION FOR YOUR DEPENDENTS' TRAVEL WAS NOT INCLUDED IN YOUR ORDERS OF MAY 1, 1962, BECAUSE OF A MISUNDERSTANDING AS TO THE DATE OF YOUR BASIC QUALIFICATION FOR TRANSPORTATION OF DEPENDENTS ON CHANGE OF STATION. IN THE CIRCUMSTANCES IT WILL BE CONSIDERED THAT YOUR DEPENDENTS' TRAVEL WAS AUTHORIZED AND APPROVED WITHIN THE CONTEMPLATION OF THE CITED PROVISIONS OF PARAGRAPH 7008-2B.

WHERE A MEMBER'S DEPENDENTS ARE AUTHORIZED, AS DISTINGUISHED FROM SPECIFICALLY DIRECTED, TO USE GOVERNMENT TRANSPORTATION FOR OVERSEAS TRAVEL AND USE COMMERCIAL TRANSPORTATION AT PERSONAL EXPENSE, THE MEMBER MAY BE REIMBURSED UNDER THE APPLICABLE PROVISIONS OF THE JOINT TRAVEL REGULATIONS FOR THE COST OF SUCH TRAVEL ON THE BASIS OF THE STANDARD PRICES WHICH THE SPONSORING SERVICE WOULD HAVE BEEN REQUIRED TO PAY HAD THE TRAVEL BEEN BY GOVERNMENT TRANSPORTATION. SEE 40 COMP. GEN. 482 AND 41 ID. 100. PARAGRAPH 3308, AIR FORCE MANUAL 75-4, DATED JUNE 20, 1961, WHICH WAS IN EFFECT AT THE TIME TRAVEL WAS PERFORMED, PROVIDES THAT THE NORMAL ROUTING OF PERSONNEL AND THEIR DEPENDENTS TO AND FROM OVERSEAS IS CONTAINED IN ATTACHMENT 17 TO THE MANUAL. THE ROUTING AND MODE OF TRAVEL FROM CONTINENTAL UNITED STATES TO TURKEY SET FORTH IN ATTACHMENT 17 IS BY MILITARY AIR TRANSPORT SERVICE FROM MCGUIRE AIR FORCE BASE, NEW JERSEY, TO FRANKFURT, GERMANY, AND BY COMMERCIAL AIR TO DESTINATION. ACCORDINGLY, WHILE YOU ARE ENTITLED TO REIMBURSEMENT FOR THE TRANSPORTATION OF YOUR DEPENDENTS, SUCH REIMBURSEMENT MAY NOT EXCEED THE COST OF SUCH TRANSPORTATION COMPUTED ON A MILEAGE BASIS FROM OMAHA, NEBRASKA, TO MCGUIRE AIR FORCE BASE, NEW JERSEY, PLUS THE COST TO THE GOVERNMENT HAD MILITARY AIR TRANSPORT SERVICE TRANSPORTATION BEEN PROVIDED BETWEEN MCGUIRE AIR FORCE BASE AND FRANKFURT AND THE COST OF COMMERCIAL AIR FARE FROM FRANKFURT TO DESTINATION, LESS THE AMOUNT YOU WERE PREVIOUSLY PAID UNDER THE SETTLEMENT OF JULY 31, 1963, FOR THEIR TRAVEL.
