BY LETTER DATED OCTOBER 16, 1963, REFERENCE 5114/141, YOU REQUESTED OUR PERMISSION TO WRITE-OFF AN ACCOUNTS PAYABLE WHICH INVOLVES PURCHASE ORDER 404 DATED OCTOBER 19, 1954, TO THE NEWGOOD COMPANY. YOU SAY THAT WHILE REPEATED ATTEMPTS HAVE BEEN MADE TO OBTAIN A BILLING FROM THIS COMPANY SUCH EFFORTS HAVE FAILED AND YOU HAVE NOT RECEIVED A REPLY TO YOUR CORRESPONDENCE.

WE WOULD HAVE NO OBJECTION TO HAVING THIS ACCOUNT WRITTEN OFF SO LONG AS THE LEGAL RIGHTS OF THE NEWGOOD COMPANY ARE NOT DEFEATED BY SUCH ACTION. IN THIS REGARD, WE DIRECT YOUR ATTENTION TO THE LAW CODIFIED AT 31 U.S.C. 71A, WHICH GIVES A CLAIMANT UP TO 10 YEARS AFTER HIS CLAIM ACCRUES TO FILE A CLAIM OF THIS TYPE WITH THE GENERAL ACCOUNTING OFFICE. THEREFORE, BEFORE WRITING THIS ACCOUNT OFF, A SUFFICIENT RECORD SHOULD BE MADE OF THIS TRANSACTION FOR RETENTION UNTIL THE 10 YEAR PERIOD REFERRED TO ABOVE HAS EXPIRED.
