ASKS WHETHER PAYMENT OF THE VOUCHER TO THE WIDOW OF THE DECEDENT IS AUTHORIZED. ROSEMARY GLIK IS THE WIDOW OF THE DECEDENT AND THE PERSON ENTITLED TO HIS UNPAID COMPENSATION UNDER THE ACT OF AUGUST 3. IN PART: "IN CASE OF THE SEPARATION OF AN EMPLOYEE WHO IS INDEBTED FOR UNEARNED LEAVE. OR IN CASE AN EMPLOYEE IS UNABLE TO RETURN TO DUTY BECAUSE OF DISABILITY. EVIDENCE OF WHICH SHALL BE SUPPORTED BY AN ACCEPTABLE MEDICAL CERTIFICATE SINCE REFUND OF THE LEAVE ADVANCE IS NOT REQUIRED IN THE EVENT OF THE DEATH OF AN EMPLOYEE. WE ARE AWARE OF NO REASON WHY PAYMENT IN THIS CASE SHOULD NOT BE MADE. WHICH IS RETURNED HEREWITH.

YOUR LETTER OF SEPTEMBER 13, 1963, ENCLOSING A VOUCHER FOR $600.17 IN FAVOR OF MRS. ROSEMARY GLIK, REPRESENTING SICK LEAVE ADVANCED TO EDWARD E. GLIK, DECEASED, A FORMER CIVILIAN EMPLOYEE OF THE AIR FORCE, ASKS WHETHER PAYMENT OF THE VOUCHER TO THE WIDOW OF THE DECEDENT IS AUTHORIZED.

WE ASSUME THAT MRS. ROSEMARY GLIK IS THE WIDOW OF THE DECEDENT AND THE PERSON ENTITLED TO HIS UNPAID COMPENSATION UNDER THE ACT OF AUGUST 3, 1950, 64 STAT. 395, AS AMENDED, 5 U.S.C. 61F ET SEQ. CONCERNING LEAVE ADVANCED TO AN EMPLOYEE, SECTION 30.206 OF THE ANNUAL AND SICK LEAVE REGULATIONS, L-1-26, FEDERAL PERSONNEL MANUAL, PROVIDES, IN PART:

"IN CASE OF THE SEPARATION OF AN EMPLOYEE WHO IS INDEBTED FOR UNEARNED LEAVE, THE EMPLOYEE SHALL REFUND THE AMOUNT PAID HIM FOR THE PERIOD OF SUCH EXCESS, OR DEDUCTION THEREFOR SHALL BE MADE FROM ANY SALARY DUE HIM. THIS SECTION SHALL NOT APPLY IN CASES OF DEATH, RETIREMENT FOR DISABILITY, OR IN CASE AN EMPLOYEE IS UNABLE TO RETURN TO DUTY BECAUSE OF DISABILITY, EVIDENCE OF WHICH SHALL BE SUPPORTED BY AN ACCEPTABLE MEDICAL CERTIFICATE

SINCE REFUND OF THE LEAVE ADVANCE IS NOT REQUIRED IN THE EVENT OF THE DEATH OF AN EMPLOYEE, WE ARE AWARE OF NO REASON WHY PAYMENT IN THIS CASE SHOULD NOT BE MADE.

THEREFORE, THE VOUCHER, WHICH IS RETURNED HEREWITH, PROPERLY MAY BE CERTIFIED FOR PAYMENT.
