WE HAVE BEEN ADVISED BY THE DEPARTMENT OF THE NAVY THAT AT THE TIME THE INVITATION WAS ISSUED. THE RADIO CORPORATION OF AMERICA (RCA) WAS BELIEVED TO BE THE ONLY LARGE BUSINESS CONCERN ON THE QUALIFIED PRODUCTS LIST. THE ENTIRE PROCUREMENT WAS SET ASIDE FOR SMALL BUSINESS PURSUANT TO ASPR 1-706.2 (B) (III) WHICH PERMITS A SMALL BUSINESS SET ASIDE WHEN ONE OR MORE LARGE BUSINESS CONCERNS ON A QUALIFIED PRODUCTS LIST DO NOT EVIDENCE A DESIRE TO PARTICIPATE IN THE PROCUREMENT. WE WILL CONSIDER THE PROTEST AS HAVING BEEN RESOLVED AND OUR FILE IN THE MATTER WILL BE CLOSED.

BY LETTER DATED AUGUST 21, 1963, YOU PROTESTED, ON BEHALF OF ELECTRO- VOICE, INC., AGAINST THE SMALL BUSINESS SET-ASIDE PROVISIONS OF INVITATION FOR BIDS NO. 126-132-64B, ISSUED BY THE ELECTRONICS SUPPLY OFFICE, GREAT LAKES, ILLINOIS.

WE HAVE BEEN ADVISED BY THE DEPARTMENT OF THE NAVY THAT AT THE TIME THE INVITATION WAS ISSUED, THE RADIO CORPORATION OF AMERICA (RCA) WAS BELIEVED TO BE THE ONLY LARGE BUSINESS CONCERN ON THE QUALIFIED PRODUCTS LIST. SINCE RCA INDICATED THAT IT HAD NO INTEREST IN THE PROCUREMENT, THE ENTIRE PROCUREMENT WAS SET ASIDE FOR SMALL BUSINESS PURSUANT TO ASPR 1-706.2 (B) (III) WHICH PERMITS A SMALL BUSINESS SET ASIDE WHEN ONE OR MORE LARGE BUSINESS CONCERNS ON A QUALIFIED PRODUCTS LIST DO NOT EVIDENCE A DESIRE TO PARTICIPATE IN THE PROCUREMENT. HOWEVER, UPON ADVICE FROM ELECTRO-VOICE OF ITS LARGE BUSINESS STATUS, THE 100 PERCENT SMALL BUSINESS SET-ASIDE HAS BEEN WITHDRAWN AND A 50 PERCENT SMALL BUSINESS SET-ASIDE HAS BEEN SUBSTITUTED.

IN VIEW THEREOF, WE WILL CONSIDER THE PROTEST AS HAVING BEEN RESOLVED AND OUR FILE IN THE MATTER WILL BE CLOSED.
