DAVIDSON WAS DIRECTED TO PERFORM TEMPORARY DUTY AS A MEMBER OF AN INSPECTION GROUP. BECAUSE HIS FATHER WAS SERIOUSLY ILL MR. HE WAS URGED TO ACCEPT THE ASSIGNMENT WITH THE UNDERSTANDING THAT IF HIS FATHER'S CONDITIONED WORSENED HE WAS AUTHORIZED TO RETURN TO HIS OFFICIAL DUTY STATION. IT IS REPORTED THAT HIS FATHER DIED AND MR. RETURNED TO HIS OFFICIAL DUTY STATION AND WAS REIMBURSED FOR SUCH TRAVEL EXPENSES. IT IS REPORTED TO US THAT HE HAD COMPLETED PART OF HIS ASSIGNED DUTY AND THAT THE REMAINDER THEREOF WAS SATISFACTORILY COMPLETED BY A MEMBER OF THE GROUP WITHOUT ADDITIONAL EXPENSE TO THE GOVERNMENT. DAVIDSON WAS ENTITLED TO BE RETURNED FROM HIS TEMPORARY DUTY POINT TO HIS OFFICIAL HEADQUARTERS AT GOVERNMENT EXPENSE.

YOUR LETTER OF APRIL 25, 1963, ACKNOWLEDGED APRIL 26, SUBMITS COPIES OF CORRESPONDENCE CONCERNING THE ADMINISTRATIVE ACTION OF THE AIR FORCE LOGISTICS COMMAND, WRIGHT-PATTERSON AIR FORCE BASE, OHIO, TO COLLECT FROM MR. ROBERT DAVIDSON AN ALLEGED OVERPAYMENT OF TRAVEL ALLOWANCE, WHICH ACTION HE PROTESTED. YOU REQUEST THAT WE CONSIDER THE MATTER AND ADVISE YOU.

THE DEPARTMENT OF THE AIR FORCE REPORTS THAT MR. DAVIDSON WAS DIRECTED TO PERFORM TEMPORARY DUTY AS A MEMBER OF AN INSPECTION GROUP. BECAUSE HIS FATHER WAS SERIOUSLY ILL MR. DAVIDSON REQUESTED RELIEF FROM SUCH ASSIGNMENT. HOWEVER, HE WAS URGED TO ACCEPT THE ASSIGNMENT WITH THE UNDERSTANDING THAT IF HIS FATHER'S CONDITIONED WORSENED HE WAS AUTHORIZED TO RETURN TO HIS OFFICIAL DUTY STATION. IT IS REPORTED THAT HIS FATHER DIED AND MR. DAVIDSON, FOLLOWING ADMINISTRATIVELY AGREED UPON ARRANGEMENTS IN SUCH EVENT, RETURNED TO HIS OFFICIAL DUTY STATION AND WAS REIMBURSED FOR SUCH TRAVEL EXPENSES. FURTHER, IT IS REPORTED TO US THAT HE HAD COMPLETED PART OF HIS ASSIGNED DUTY AND THAT THE REMAINDER THEREOF WAS SATISFACTORILY COMPLETED BY A MEMBER OF THE GROUP WITHOUT ADDITIONAL EXPENSE TO THE GOVERNMENT.

IN VIEW OF THE CIRCUMSTANCES OF THIS CASE, AS WELL AS OUR HOLDING IN B- 76983, JULY 2, 1948, COPY ENCLOSED FOR YOUR INFORMATION, WE BELIEVE MR. DAVIDSON WAS ENTITLED TO BE RETURNED FROM HIS TEMPORARY DUTY POINT TO HIS OFFICIAL HEADQUARTERS AT GOVERNMENT EXPENSE. WE HAVE SO ADVISED THE DEPARTMENT OF THE AIR FORCE TODAY AND HAVE REQUESTED THAT COLLECTION ACTION AGAINST MR. DAVIDSON FOR THE PROPER EXPENSES TO WHICH HE WAS ENTITLED BE CANCELLED.
