SUBPART 1-1.703-2 (D) OF THE REGULATIONS PROVIDES A 10-WORKING-DAY PERIOD WITHIN WHICH THE SMALL BUSINESS ADMINISTRATION (SBA) WILL INVESTIGATE. WHICHEVER IS THE EARLIER. WE ARE NOT AWARE OF ANY SUBSTANTIAL REASON WHY THE REGULATIONS SHOULD NOT AUTHORIZE THE SAME PERIOD OF TIME IN WHICH SBA IS PERMITTED TO DETERMINE SIZE STATUS OR TO ISSUE A CERTIFICATE OF COMPETENCY. WE WOULD HAVE NO OBJECTION TO THE CHANGE AS REQUESTED BY SBA.

TO THE ADMINISTRATOR, GENERAL SERVICES ADMINISTRATION:

BY LETTER DATED MARCH 14, 1963, THE DIRECTOR OF PROCUREMENT AND ECONOMIC POLICY, OFFICE OF THE ASSISTANT ADMINISTRATOR FOR FINANCE AND ADMINISTRATION, REQUESTED OUR COMMENTS ON A PROPOSED REVISION TO SUBPART 1 -1.703-2 OF THE FEDERAL PROCUREMENT REGULATIONS.

SUBPART 1-1.703-2 (D) OF THE REGULATIONS PROVIDES A 10-WORKING-DAY PERIOD WITHIN WHICH THE SMALL BUSINESS ADMINISTRATION (SBA) WILL INVESTIGATE, DETERMINE AND NOTIFY INTERESTED PARTIES OF THE SMALL BUSINESS STATUS OF A PROTESTED BIDDER OR OFFEROR. PARAGRAPH (E) OF THAT SUBPART PROVIDES, IN PART, THAT PROCUREMENT ACTION SHALL BE SUSPENDED PENDING SBA'S DETERMINATION OR EXPIRATION OF THE 10-DAY PERIOD, WHICHEVER IS THE EARLIER. THE LETTER ADVISES THAT SBA HAS REQUESTED THE GENERAL SERVICES ADMINISTRATION TO CONSIDER INCREASING THE TIME PERIOD TO 15 WORKING DAYS SO AS TO SUBSTANTIALLY DECREASE REQUESTS BY SBA FOR EXTENSIONS OF TIME AND TO CONFORM THE TIME PERIOD TO THAT NOW PRESCRIBED FOR THE SBA'S PROCESSING OF CERTIFICATES OF COMPETENCY.

WE ARE NOT AWARE OF ANY SUBSTANTIAL REASON WHY THE REGULATIONS SHOULD NOT AUTHORIZE THE SAME PERIOD OF TIME IN WHICH SBA IS PERMITTED TO DETERMINE SIZE STATUS OR TO ISSUE A CERTIFICATE OF COMPETENCY. ACCORDINGLY, WE WOULD HAVE NO OBJECTION TO THE CHANGE AS REQUESTED BY SBA.
