BUCHANAN: WE HAVE YOUR LETTER OF FEBRUARY 7. THE CHECKS WERE ISSUED SUBSEQUENT TO THE ONSET OF THE ILLNESS WHICH REQUIRED YOUR CONFINEMENT AT SAINT ELIZABETHS HOSPITAL. YOUR RECENT LETTER INDICATES THAT YOU HAVE FAILED TO UNDERSTAND THAT THE DISPOSITION MADE OF THE CHECKS IN QUESTION HAS RESULTED IN THE PAYMENT OF THEIR PROCEEDS TO YOU. IN THE PAST WE HAVE FURNISHED YOU WITH PHOTOSTATIC COPIES OF THE CHECKS AND WITH THE REASONS FOR THE ENDORSEMENT AND NEGOTIATING OF THE CHECKS BY THE SUPERINTENDENT OF SAINT ELIZABETHS HOSPITAL. WE HAVE ALSO CALLED TO YOUR ATTENTION THE PROVISIONS OF LAW WHICH AUTHORIZED THE DISPOSITION MADE OF THE CHECKS AND THEIR PROCEEDS. THE CONTINUED RECEIPT OF CORRESPONDENCE FROM YOU INDICATES THAT PERHAPS YOU HAVE NOT UNDERSTOOD THAT YOUR RIGHTS WITH RESPECT TO THESE CHECKS AND THEIR PROCEEDS HAVE BEEN CAREFULLY PROTECTED AND PRESERVED DURING THE TIME YOU WERE AT SAINT ELIZABETHS HOSPITAL AND THAT ALL ACTION TAKEN WAS IN ACCORDANCE WITH LAW.

WE HAVE YOUR LETTER OF FEBRUARY 7, 1963, IN WHICH YOU REFER TO PRIOR CORRESPONDENCE OF THIS OFFICE FURNISHING YOU WITH AN EXPLANATION CONCERNING THE DISPOSITION OF CERTAIN TREASURER'S CHECKS ISSUED IN YOUR NAME FOR SALARY AND LEAVE INCIDENT TO YOUR EMPLOYMENT IN THE WAR DEPARTMENT. THE CHECKS WERE ISSUED SUBSEQUENT TO THE ONSET OF THE ILLNESS WHICH REQUIRED YOUR CONFINEMENT AT SAINT ELIZABETHS HOSPITAL. YOUR RECENT LETTER INDICATES THAT YOU HAVE FAILED TO UNDERSTAND THAT THE DISPOSITION MADE OF THE CHECKS IN QUESTION HAS RESULTED IN THE PAYMENT OF THEIR PROCEEDS TO YOU.

IN THE PAST WE HAVE FURNISHED YOU WITH PHOTOSTATIC COPIES OF THE CHECKS AND WITH THE REASONS FOR THE ENDORSEMENT AND NEGOTIATING OF THE CHECKS BY THE SUPERINTENDENT OF SAINT ELIZABETHS HOSPITAL. WE HAVE ALSO CALLED TO YOUR ATTENTION THE PROVISIONS OF LAW WHICH AUTHORIZED THE DISPOSITION MADE OF THE CHECKS AND THEIR PROCEEDS. THE PROVISIONS, APPEARING IN TITLE 24, SECTION 165, OF THE U.S.C. PERMIT THE SUPERINTENDENT TO RECEIVE AND ACCOUNT FOR MONEYS BELONGING TO PATIENTS AND TO DRAW, FROM SUCH PATIENTS' ACCOUNTS, FUNDS FOR THE USE OF THE PATIENTS.

THE CONTINUED RECEIPT OF CORRESPONDENCE FROM YOU INDICATES THAT PERHAPS YOU HAVE NOT UNDERSTOOD THAT YOUR RIGHTS WITH RESPECT TO THESE CHECKS AND THEIR PROCEEDS HAVE BEEN CAREFULLY PROTECTED AND PRESERVED DURING THE TIME YOU WERE AT SAINT ELIZABETHS HOSPITAL AND THAT ALL ACTION TAKEN WAS IN ACCORDANCE WITH LAW. AS WE HAVE SHOWN IN OUR REFERENCE TO THE PROVISIONS OF LAW ABOVE, AN ACCOUNT IN YOUR NAME WAS SET UP AT THE HOSPITAL FROM THE AMOUNT OF THESE CHECKS AND AS YOU REQUIRED ITEMS OF MERCHANDISE, SUCH AS NEW APPAREL, STATIONERY, CANDY, ETC., THE COST THEREOF WAS CHARGED AGAINST YOUR ACCOUNT. ANY AMOUNT UNEXPENDED FROM YOUR ACCOUNT WOULD BE REFUNDED TO YOU UPON YOUR RELEASE. THUS IT IS APPARENT THAT YOU HAVE RECEIVED THE BENEFIT OF THE CHECKS IN QUESTION.

IN ORDER THAT YOU MIGHT OBTAIN INFORMATION CONCERNING THE DISPOSITION OF THE AMOUNTS CREDITED TO YOUR ACCOUNT BY THE SUPERINTENDENT OF THE SAINT ELIZABETHS HOSPITAL WE SUGGEST THAT YOU WRITE TO THAT HOSPITAL AND REQUEST THIS INFORMATION. OUR OFFICE HAS FULLY ADVISED YOU OF THE LAW AND FACTS CONCERNING THE DISPOSITION OF THESE CHECKS AND WE FEEL THAT FURTHER CORRESPONDENCE ON THIS MATTER WITH THIS OFFICE WILL SERVE NO USEFUL PURPOSE. FOR THIS REASON WE MUST ADVISE YOU THAT FURTHER CORRESPONDENCE RECEIVED FROM YOU HERE WILL BE FILED WITHOUT REPLY.
