INC.: FURTHER REFERENCE IS MADE TO OUR LETTER OF NOVEMBER 28. IT APPEARS THAT THE SUBSTANCE OF YOUR PROTEST WAS THAT THE INVITATION DISCRIMINATED AGAINST THE PEOPLE IN ARKANSAS AND OUTSIDE THE MEMPHIS. CITY LIMITS BY PROVIDING THAT THE CONTRACTOR MUST HAVE A WAREHOUSE IN MEMPHIS. AS YOU WERE INFORMED IN OUR LETTER OF NOVEMBER 28. THE MATTER WAS TAKEN UP WITH THE DEPARTMENT OF THE AIR FORCE. THE DEPARTMENT NOW ADVISES THAT THERE WAS NO INTENTION OF EXCLUDING BIDDERS BY RESTRICTING THE FACILITY LOCATION TO THE CORPORATE LIMITS OF THE CITY OF MEMPHIS. THE INVITATION WAS SUBSEQUENTLY AMENDED TO ELIMINATE THE RESTRICTION. IT IS ASSUMED THAT THE ACTION TAKEN SATISFACTORILY DISPOSES OF YOUR PROTEST.

FURTHER REFERENCE IS MADE TO OUR LETTER OF NOVEMBER 28, 1962, ACKNOWLEDGING RECEIPT OF A COPY OF YOUR LETTER DATED NOVEMBER 16 WHEREIN YOU PROTESTED TO THE CONTRACTING OFFICER, U.S.A.F., 2709 MOTOR VEHICLE SQUADRON, MEMPHIS, TENNESSEE, AGAINST CERTAIN SPECIFICATIONS CONTAINED IN INVITATION TO BID NO. 40-604-62-2582. IT APPEARS THAT THE SUBSTANCE OF YOUR PROTEST WAS THAT THE INVITATION DISCRIMINATED AGAINST THE PEOPLE IN ARKANSAS AND OUTSIDE THE MEMPHIS, TENNESSEE, CITY LIMITS BY PROVIDING THAT THE CONTRACTOR MUST HAVE A WAREHOUSE IN MEMPHIS, TENNESSEE.
