TO THE SECRETARY OF THE AIR FORCE: REFERENCE IS MADE TO LETTER OF DECEMBER 19. WOULD HAVE GIVEN CREDIT FOR THE PAYMENTS MADE BY EACH OF THE 27 ENLISTED MEMBERS AND FORMER ENLISTED MEMBERS OF THE AIR FORCE LISTED IN THE BILL DURING THE PERIOD JUNE 2. WHO WAS THEN A CIVILIAN CLERK IN THE ACCOUNTING AND FINANCE OFFICE OF THE SEPARATION CENTER AT MANHATTAN BEACH AIR FORCE STATION. THE BILL WOULD HAVE PROVIDED THAT ANY PERSON NAMED THEREOF WHO MADE REPAYMENTS BOTH TO THE UNITED STATES AND TO THE SAID LORENZ. THE NET EFFECT OF THE BILL WOULD HAVE BEEN TO RELIEVE THE NAMED INDIVIDUALS OF THEIR INDEBTEDNESS TO THE UNITED STATES FOR THE ACCRUED LEAVE OVERPAYMENTS TO THE EXTENT OF THE REFUNDS MADE TO MR.

REFERENCE IS MADE TO LETTER OF DECEMBER 19, 1962, FROM THE ASSISTANT SECRETARY OF THE AIR FORCE ATTACHING A COPY OF A LETTER DATED DECEMBER 14, 1962, FROM REPRESENTATIVE PETER W. RODINO, JR., OF NEW JERSEY, IN WHICH THE CONGRESSMAN STATES HE INTENDS TO REINTRODUCE IN THE 88TH CONGRESS H.R. 13408 OF THE 87TH CONGRESS AND REQUESTS THAT SUSPENSION OF COLLECTION ACTION AGAINST THE INDIVIDUALS CONCERNED BE CONTINUED.

H.R. 13408, 87TH CONGRESS, WOULD HAVE GIVEN CREDIT FOR THE PAYMENTS MADE BY EACH OF THE 27 ENLISTED MEMBERS AND FORMER ENLISTED MEMBERS OF THE AIR FORCE LISTED IN THE BILL DURING THE PERIOD JUNE 2, 1956, THROUGH JUNE 4, 1957, TO RONALD L. LORENZ, WHO WAS THEN A CIVILIAN CLERK IN THE ACCOUNTING AND FINANCE OFFICE OF THE SEPARATION CENTER AT MANHATTAN BEACH AIR FORCE STATION, NEW YORK, AS REFUNDS OF OVERPAYMENTS OF ACCRUED LEAVE RECEIVED BY THEM AS THE RESULT OF FRAUDULENT TRANSACTIONS OF MR. LORENZ. ALSO, THE BILL WOULD HAVE PROVIDED THAT ANY PERSON NAMED THEREOF WHO MADE REPAYMENTS BOTH TO THE UNITED STATES AND TO THE SAID LORENZ, THE TOTAL OF WHICH EXCEEDED THE AMOUNT DUE TO THE UNITED STATES, SHOULD BE PAID THE EXCESS IF OTHERWISE PROPER. THE NET EFFECT OF THE BILL WOULD HAVE BEEN TO RELIEVE THE NAMED INDIVIDUALS OF THEIR INDEBTEDNESS TO THE UNITED STATES FOR THE ACCRUED LEAVE OVERPAYMENTS TO THE EXTENT OF THE REFUNDS MADE TO MR. LORENZ.

SINCE REPRESENTATIVE RODINO INTENDS TO REINTRODUCE H.R. 13408 IN THE 88TH CONGRESS THE ASSISTANT SECRETARY STATES THAT WITH OUR CONCURRENCE, THE DEPARTMENT OF THE AIR FORCE WILL SUSPEND COLLECTION ACTION PENDING CONSIDERATION OF THE RELIEF LEGISLATION BY THE 88TH CONGRESS. THIS OFFICE HAS NO OBJECTION TO SUSPENSION OF COLLECTION ACTION BY THE AIR FORCE AS TO THE 27 MEMBERS MENTIONED IN H.R. 13408 PENDING CONSIDERATION OF RELIEF LEGISLATION IN THE 88TH CONGRESS PROVIDED THE RIGHTS AND INTERESTS OF THE GOVERNMENT ARE NOT PREJUDICED. SINCE THE INDEBTEDNESS TO THE UNITED STATES OF SOME OF THE 27 MEMBERS HAS BEEN CERTIFIED BY THE AIR FORCE TO THIS OFFICE FOR COLLECTION OUR CLAIMS DIVISION IS BEING SIMILARLY ADVISED.
