YOU REQUESTED A DECISION AS TO WHETHER THE ARMS CONTROL AND DISARMAMENT AGENCY IS AUTHORIZED TO INSTITUTE. THE GRANT RECIPIENTS WOULD NOT HAVE ACCESS TO CLASSIFIED MATERIALS. THE BASIC PURPOSE OF THE PROGRAM IS TO ASSIST THE ARMS CONTROL AND DISARMAMENT AGENCY IN STIMULATING INTEREST IN AND BROADENING ITS SUPPORT OF SOCIAL AND BEHAVORIAL RESEARCH BEARING ON IMPORTANT ISSUES AND PROBLEMS IN THE AREAS OF ITS CONCERNS. THE PROGRAM IS CONCEIVED AS BEING EXPERIMENTAL IN NATURE AND IS SPECIFICALLY DIRECTED TOWARD PROVIDING SUPPORT FOR PREDOCTORAL CANDIDATES ENGAGED IN DISSERTATION RESEARCH. PERIOD OF THREE YEARS IS CONTEMPLATED AS BEING REQUIRED TO DETERMINE WHETHER A PROGRAM OF DISSERTATION RESEARCH SUPPORT SERVES AS AN EFFECTIVE INSTRUMENT FOR BROADENING ACDA'S SOCIAL AND BEHAVORIAL RESEARCH PROGRAM AND ATTRACTS A GROWING NUMBER OF GRADUATE STUDENTS TO ENGAGE IN RESEARCH WHICH WILL CONTRIBUTE TO THE SCIENTIFIC LITERATURE DEALING WITH PROBLEMS RELATED TO ARMS CONTROL AND DISARMAMENT.

BY LETTER OF MAY 9, 1968, YOU REQUESTED A DECISION AS TO WHETHER THE ARMS CONTROL AND DISARMAMENT AGENCY IS AUTHORIZED TO INSTITUTE, THROUGH AGREEMENT WITH THE NATIONAL ACADEMY OF SCIENCES, A PROGRAM OF FELLOWSHIP SUPPORT IN THE SOCIAL AND BEHAVORIAL SCIENCES FOR PH.D. DISSERTATIONS BEARING ON ARMS CONTROL ISSUES. FROM INFORMATION FURNISHED WITH YOUR LETTER, THE NATURE OF THE PROPOSED PROGRAM MAY BE DESCRIBED AS FOLLOWS:

THE PROGRAM WOULD BE ADMINISTERED BY THE NATIONAL RESEARCH COUNCIL OF THE ACADEMY UNDER CONTRACT WITH THE ARMS CONTROL AND DISARMAMENT AGENCY. THE NATIONAL RESEARCH COUNCIL WOULD ESTABLISH A SEVEN-MEMBER MULTIDISCIPLINARY ADVISORY COMMITTEE, THREE MEMBERS OF WHICH WOULD BE DRAWN FROM THE SOCIAL SCIENCE ADVISORY BOARD OF ACDA. THIS ADVISORY COMMITTEE WOULD BE RESPONSIBLE FOR SPECIFYING THE KINDS OF DISSERTATION SUBJECTS RELEVANT TO THE MISSIONS OF ACDA, IDENTIFYING THE GRADUATE INSTITUTIONS OR DEPARTMENTS ELIGIBLE TO APPLY FOR DISSERTATION SUPPORT, GIVING ADVICE TO ACDA ON THE MEANS TO BE USED TO INVITE PROPOSALS, EVALUATING THE PROPOSALS SUBMITTED, AND AWARDING DISSERTATION GRANTS. THE GRANT RECIPIENTS WOULD NOT HAVE ACCESS TO CLASSIFIED MATERIALS.

PERIOD OF THREE YEARS IS CONTEMPLATED AS BEING REQUIRED TO DETERMINE WHETHER A PROGRAM OF DISSERTATION RESEARCH SUPPORT SERVES AS AN EFFECTIVE INSTRUMENT FOR BROADENING ACDA'S SOCIAL AND BEHAVORIAL RESEARCH PROGRAM AND ATTRACTS A GROWING NUMBER OF GRADUATE STUDENTS TO ENGAGE IN RESEARCH WHICH WILL CONTRIBUTE TO THE SCIENTIFIC LITERATURE DEALING WITH PROBLEMS RELATED TO ARMS CONTROL AND DISARMAMENT.

PLANNED EXPENDITURES UNDER THE PROPOSED PROGRAM ARE ON THE ORDER OF$30,000 FOR DISSERTATION SUPPORT AWARDS AND $16,000 FOR COSTS OF ADMINISTRATION, IN EACH OF THE THREE EXPERIMENTAL YEARS.

SECTION 31 OF THE ARMS CONTROL AND DISARMAMENT ACT, 75 STAT. 631, 633, AUTHORIZES AND DIRECTS THE DIRECTOR TO INSURE THE ACQUISITION OF A FUND OF THEORETICAL AND PRACTICAL KNOWLEDGE IN CERTAIN SPECIFIED AREAS CONCERNING DISARMAMENT. THE SECTION PROVIDES THAT: "* * * TO THIS END, THE DIRECTOR IS AUTHORIZED AND DIRECTED, UNDER THE DIRECTION OF THE PRESIDENT, (1) TO INSURE THE CONDUCT OF RESEARCH, DEVELOPMENT, AND OTHER STUDIES IN THE FIELD OF ARMS CONTROL AND DISARMAMENT; (2) TO MAKE ARRANGEMENTS (INCLUDING CONTRACTS, AGREEMENTS, AND GRANTS) FOR THE CONDUCT OF RESEARCH, DEVELOPMENT, AND OTHER STUDIES IN THE FIELD OF ARMS CONTROL AND DISARMAMENT BY UNITED STATES PRIVATE OR PUBLIC INSTITUTIONS OR PERSONS * *

IN LIGHT OF THE AUTHORITY CONTAINED IN THE QUOTED PORTION, IT IS OUR OPINION THAT APPROPRIATIONS TO IMPLEMENT THE PROVISIONS OF THE ARMS CONTROL AND DISARMAMENT ACT, IN THE ABSENCE OF ANY RESTRICTION THEREIN TO THE CONTRARY, MAY PROPERLY BE UTILIZED TO CARRY OUT THE CONTEMPLATED DISSERTATION SUPPORT PROGRAM, ASSUMING, OF COURSE, THAT THE TOPICS INVOLVED IN SUCH SUPPORT ARE OTHERWISE WITHIN THE LIMITATIONS LAID DOWN IN SECTION 31. SEE PUB. L. 90-133, 81 STAT. 410, 432, FOR APPROPRIATION COVERING FISCAL YEAR 1968.

WE NOTE, AT PAGE 17 OF THE SENATE HEARINGS BEFORE THE COMMITTEE ON FOREIGN RELATIONS, 89TH CONGRESS, FIRST SESSION ON S. 672 AND H.R. 2998 (1965), THAT SENATOR HICKENLOOPER RAISED A QUESTION AS TO WHETHER ACADEMIC DEGREE DISSERTATION SUPPORT HAD BEEN GRANTED IN THE PAST AND THAT THE DIRECTOR ANSWERED IN THE AFFIRMATIVE. THE SENATOR THEREUPON STATED: "AND THEY (APPLICANTS FOR GRADUATE DEGREES) HAVE USED THE RESULTS OF THIS RESEARCH FOR WHICH THEY ARE PAID TOWARD THE ACQUIRING OF A PERSONAL DEGREE" , THEREBY AT LEAST RAISING QUESTION AS TO HIS ATTITUDE TOWARDS THE PRACTICE. HOWEVER, THE MATTER WAS NOT PURSUED FURTHER.

OUR OPINION THAT THE PROPOSED PROGRAM IS LEGALLY AUTHORIZED IS NOT TO BE CONSTRUED AS INDICATING ANY VIEW CONCERNING ITS MERIT.
