LAWRENCE WHYLE: REFERENCE IS MADE TO YOUR LETTER OF MAY 5. WHILE IT WAS REPRESENTED TO YOU BY CERTAIN INDIVIDUALS IN THE GENERAL SERVICES ADMINISTRATION THAT YOU WERE UNDERPAID BY CROSBY CONTRACTING COMPANY. BECAUSE YOU WERE NOT PAID PAINTER'S WAGES. THE EVIDENCE SUBMITTED TO OUR OFFICE BY THE GENERAL SERVICES ADMINISTRATION FAILED TO SUBSTANTIATE THAT YOU WERE REQUIRED TO DO ANY PAINTING OR WERE EXPERIENCED AS A PAINTER. ON THE RECORD THAT WAS FURNISHED TO OUR OFFICE. WE FAILED TO FIND ANY EVIDENCE THAT SUPPORTED THE CONCLUSION THAT YOU WERE UNDERPAID.

REFERENCE IS MADE TO YOUR LETTER OF MAY 5, 1962, CONCERNING THE DISALLOWANCE OF YOUR CLAIM FOR ADDITIONAL WAGES YOU BELIEVE TO BE DUE YOU FOR PAINTING WORK YOU ALLEGE YOU PERFORMED FOR CROSBY CONTRACTING COMPANY, INC., UNDER CONTRACT GS-02B-4663.

WHILE IT WAS REPRESENTED TO YOU BY CERTAIN INDIVIDUALS IN THE GENERAL SERVICES ADMINISTRATION THAT YOU WERE UNDERPAID BY CROSBY CONTRACTING COMPANY, INC., BECAUSE YOU WERE NOT PAID PAINTER'S WAGES, THE EVIDENCE SUBMITTED TO OUR OFFICE BY THE GENERAL SERVICES ADMINISTRATION FAILED TO SUBSTANTIATE THAT YOU WERE REQUIRED TO DO ANY PAINTING OR WERE EXPERIENCED AS A PAINTER.

IN THE CIRCUMSTANCES, ON THE RECORD THAT WAS FURNISHED TO OUR OFFICE, WE FAILED TO FIND ANY EVIDENCE THAT SUPPORTED THE CONCLUSION THAT YOU WERE UNDERPAID. THEREFORE, WE HAD NO ALTERNATIVE OTHER THAN TO DISALLOW YOUR CLAIM.

FURTHER, THE MONEY THAT WAS WITHHELD FROM THE CONTRACTOR'S EARNINGS UNDER THE CONTRACT FOR WAGE ADJUSTMENTS HAS BEEN RELEASED TO THE CONTRACTOR AND IS NO LONGER AVAILABLE FOR ANY DISPOSITION BY US. ..END :
