FURTHER REFERENCE IS MADE TO YOUR LETTER DATED APRIL 3, 1962, IN WHICH YOU REQUEST A REVIEW OF THE SETTLEMENT DISALLOWING YOUR CLAIM FOR ADDITIONAL FREIGHT CHARGES FOR TRANSPORTATION FURNISHED UNDER GOVERNMENT BILL OF LADING AF-1636934 ON THE SHIPMENT OF HOUSEHOLD GOODS OF A/2C WILLIAM T. WILSON FROM PEPPERRELL AIR FORCE BASE, ST. JOHNS, NEWFOUNDLAND, TO WRIGHTSTOWN, NEW JERSEY. PAYMENT WAS MADE ORIGINALLY ON THE BASIS OF A WEIGHT OF 2,876 POUNDS, SUPPORTED BY THE BILL OF LADING AND A WEIGHMASTER'S WEIGHT TICKET DATED APRIL 14, 1960. YOU LATER FILED A SUPPLEMENTAL BILL NO. N-32187 FOR $128.57, AS AN ADDITIONAL ALLOWANCE CONTENDING THAT THE SHIPMENT ACTUALLY WEIGHED 3,436 POUNDS, RATHER THAN THE 2,876 POUNDS AS ORIGINALLY CLAIMED.

THE SUPPLEMENTAL BILL WAS DISALLOWED BY SETTLEMENT CERTIFICATE DATED JANUARY 15, 1962, FOR THE REASON THAT IN THE ABSENCE OF A CORRECTED CERTIFICATE OR OTHER EVIDENCE SHOWING THE ADDITIONAL WEIGHT CLAIMED, CHARGES COULD NOT BE ALLOWED IN EXCESS OF THOSE BASED ON THE 2,876 POUNDS DELIVERED UNDER DD (DEPARTMENT OF DEFENSE) FORM 619.

WITH YOUR LETTER OF APRIL 3, 1962, YOU ENCLOSED PHOTOSTATIC COPIES OF THE ORIGINAL WEIGHT CERTIFICATE DATED APRIL 4, 1960, SHOWING THE NET WEIGHT SHIPPED AS 2,876 POUNDS, TOGETHER WITH A WEIGHT CERTIFICATE DATED MAY 4, 1960, INDICATING AN ADDITIONAL NET WEIGHT OF 560 POUNDS, MAKING A TOTAL OF 3,436 POUNDS. HOWEVER, THE COPY OF THE WEIGHT CERTIFICATE DATED MAY 4, 1960, PURPORTEDLY REPRESENTING THE OVERFLOW PORTION OF THE SUBJECT SHIPMENT, DOES NOT CONTAIN ANY INFORMATION TO SUBSTANTIATE OR PROVE THAT THE NET WEIGHT OF 560 POUNDS IS, IN FACT, AN OVERFLOW PORTION OF THE SHIPMENT OF HOUSEHOLD GOODS OF A/2C WILLIAM T. WILSON. IT IS NOTED THAT THE WEIGHT CERTIFICATE DATED MAY 4, 1960, SHOWS THAT IT WAS FOR A "LOAD OF FURNITURE" FROM "ALLIED VANS" TO HALIFAX TRANSFER (2).' THE ORIGINAL TICKET DATED APRIL 14, 1960, SHOWS THE SHIPMENT WEIGHED CAME FROM THE ADDRESS OF THE OWNER OF THE HOUSEHOLD GOODS.

ACCORDINGLY, IN THE ABSENCE OF A SUBSTANTIAL SHOWING THAT THE ADDITIONAL 560 POUNDS ACTUALLY CONSISTED OF AN OVERFLOW OF THE SHIPMENT IN QUESTION, THE SETTLEMENT DISALLOWING YOUR CLAIM IS SUSTAINED.
