THE INVITATION, WHICH WAS ISSUED ON OCTOBER 20, 1961, BY THE AVIATION SUPPLY OFFICE, PROVIDED FOR THE PROCUREMENT OF 950,000 FORMS; PRINTED, 4ND -ASO-4440/2 (REV. 3-60), ETC., AND CONTAINED A NOTICE OF A SMALL BUSINESS SET-ASIDE, (TOTAL), WHICH LIMITED PARTICIPATION TO SMALL BUSINESS CONCERNS. A TOTAL OF 6 BIDS WERE RECEIVED WHICH RANGED IN TOTAL PRICE FROM $23,845 TO $43,947. BOTH OF THE APPARENT LOW BIDS, WHICH WERE SUBMITTED BY AUTOGRAPHIC BUSINESS FORMS, INC., SOUTH HACKENSACK, NEW JERSEY, WERE REJECTED AS BEING NONRESPONSIVE TO THE TERMS AND CONDITIONS OF THE INVITATION FOR BIDS. THE NEXT LOW BID OF $0.02973 EACH WAS SUBMITTED BY MCGREGOR AND WERNER, NC., WASHINGTON, D.C.,AND THIS CORPORATION WAS REQUESTED TO CONFIRM ITS PRICE AND FURNISH CERTAIN OTHER INFORMATION. UPON COMPLIANCE WITH THIS REQUEST, CONTRACT NO. N383 (288) 72861A WAS AWARDED TO MCGREGOR AND WERNER, INC., ON NOVEMBER 15, 1961, IN THE TOTAL AMOUNT OF $28,243.50. IN YOUR TELEGRAM OF DECEMBER 26, 1961, YOU ALLEGE THAT THE AWARD WAS NOT IN COMPLIANCE WITH THE RULES GOVERNING SMALL BUSINESS SET-ASIDES IN THAT YOU BELIEVE THE COLUMBIA RIBBON AND CARBON COMPANY AT GLEN COVE, NEW YORK, WHO DOES NOT QUALIFY AS SMALL BUSINESS, IS THE MANUFACTURER UNDER THE CONTRACT.

THE DEPARTMENT OF THE NAVY HAS ADVISED US THAT ON NOVEMBER 17, 1961, PURCHASE ORDER NO. 71891-B WAS ISSUED BY MCGREGOR AND WERNER, INC., TO AUTOGRAPHIC BUSINESS FORMS, INC., FOR THE PRINTING OF 950,000 FORMS; PRINTED, TYPE I, CLASS I, GRADE C, CONTINUOUS MARGINALLY PUNCHED, OFFSET 14 7/8 INCHES BY 10 INCHES. AS YOU KNOW, BOTH MCGREGOR AND WERNER, INC., THE PRIME CONTRACTOR, AND AUTOGRAPHIC BUSINESS FORMS, INC., ITS PRINTING SUBCONTRACTOR, HAVE BEEN DETERMINED TO BE SMALL BUSINESS BY THE SMALL BUSINESS ADMINISTRATION.

IN VIEW OF THE FOREGOING, WE FIND NO LEGAL OBJECTION TO THE PROCUREMENT PROCEDURES FOLLOWED BY THE DEPARTMENT OF THE NAVY IN THE MATTER ON THE BASIS OF THE REPORTED FACTS.
